BBMP’s improvement fee quashed
The Bruhat Bangalore Mahanagara Palike’s attempt to
collect crores of rupees as improvement fee from certain categories of
property owners in the newly added areas has received blow for the
second time with the High Court again quashing the revised sum of Rs.
550 per sq m of site/land.
The court declared that
the fee was determined without systematic exercise as ordered by it last
year and the method adopted to arrive at the amount does not give an
impression that it was carried out in a fair and reasonable manner.
Justice
A.S. Bopanna delivered the verdict while partly allowing 165 petitions
filed by several individual land owners as well as developers having
properties in Mahadevapura, Bommanahalli, Yelahanka and Rajarajeshhwri
Nagar Zones.
The High Court in April 2012 had quashed
the differential improvement fee fixed based on the dimension of the
sites besides stating that improvement fee cannot be made as a
precondition for registration, transfer, bifurcation and amalgamation of
khatas.
