CAT raps MCD for stalling promotion
NEW DELHI: The Central Administrative Tribunal has pulled up Municipal Corporation of Delhi (MCD) for rejecting the claim of a woman ad-hoc employee and directed the civic agency to consider her for promotion.
“It is not proper for the MCD as a model employer to deny consideration as a fundamental right to the applicant in the matter of promotion and they cannot approbate and reprobate simultaneously,” the Tribunal bench comprising Members Veena Chhotray and Shanker Raju said.
The Tribunal passed the order on the petition of one Bimla Devi challenging removal of her name from the list for promotion to the post of Ayurvedic Compounder despite being eligible for it. The MCD had contended that the eligibility for the post is three years of regular service. The tribunal said, “Right to be considered for promotion in accordance with rules and on equitable and fair basis constitutes a fundamental right.”
