Nod for digitising property registration

Express news service Tags : law, Delhi Posted: Tue Sep 14 2010, 05:07 hrs

Cheats who fleece property buyers using fake sale deeds will now have to shut shop, with the Delhi Cabinet on Monday approving a modern digitised mechanism to replace the archaic property registration procedure. The new system will make it necessary for all properties to be registered in a new owner’s name each time it is sold.

The Delhi Survey Registration and Recordal of Title to Immovable Properties in Urban Areas Bill envisages setting up a single, secure and efficient system for registration of immovable properties in the city.

This new system will now provide “titles” to a property owner, replacing the present practice of registration of sales deeds. While the present system is not inaccurate, the new method has a more consolidated approach to ensure “undisputed” ownership — doing away with the rampant practice of acquiring property by registering fake sales deeds.

The biggest relief for property owners will be that the government will now be the guarantor for a property when it provides it a “title”. In case there is still fraud, the government is liable to pay compensation to any party who has been cheated in the transaction.

The Delhi Cabinet, presided over by Chief Minister Sheila Dikshit, approved the draft legislation which seeks to give genuine owners a unique identification number. And each time the property is sold to a new owner, a new identification number will be issued and a record will be maintained of all previous owners of the property. The Bill will now be sent to the Union Government for approval.

An online database of all genuine properties will be put in place to ensure transparency, the officials said. The Bill also envisages setting up of an Urban Property Registration and Title Recording Authority, which will be responsible for running the transparent and digitised mechanism for registration of properties.

Other key Cabinet decisions

EASIER MARRIAGE REGISTRATION

The Delhi Cabinet has decided to relax marriage registration rules in the city after which couples from anywhere in the country will be able to easily get their marriages registered here. The couples will no longer require to prove that either of them or their parents have been a resident of the city for at least a month. The marriage, however, has to take place in the area of the city that falls under the jurisdiction of the registrar concerned. The decision comes against the backdrop of several cases of honour killing taking place in the city as well as in neighbouring states. Now, couples facing the threat of khap panchayats will also be able to get their marriages registered in Delhi.

MORE RELIEF FOR KASHMIRIS

The Cabinet decided to increase the financial assistance being provided to Kashmiri migrant families by up to Rs 1,000. Till now the government was paying Rs 1,000 per head per month, subject to a ceiling of Rs 4,000 per family of four or more members. Now, it has increased it to Rs 1,250 per head per month and Rs 5,000 for per family of four or more. Delhi government supports 3,624 Kashmiri migrant families. The assistance had started in 1990 with an amount of Rs 125 per head.

NOD FOR NEW POWER PLANT

The Cabinet has approved a proposal to set up a gas-based 750-MW Pragati Power II plant at Bamnauli. The project is aimed at ensuring that Delhi generates at least 50 per cent of its demand. At present, the Capital’s four power plants generate 800 to 1000 MW as compared to a peak season demand of 4700 MW.
