High Court declines to stay auction of Taj Mansingh property

Indian Hotels Corporation, which runs Capital’s luxury Taj Mansingh Hotel, has failed to stop New Delhi Municipal Corporation from auctioning the land on which the hotel stands.

Declining to stay the auction process set off after the lease of the Tata group company expired, the Delhi High Court issued notice to the civic body to respond to the company’s plea seeking to restrain NDMC from auctioning the property.

The court, however, said that NDMC cannot dispossess Taj from the property till it delivers its final verdict. It has also said that Indian Hotels is free to approach the court if the civic body takes any “coercive” step.

While the corporation needs to respond to Taj Hotel’s plea within the next two weeks, the next hearing has been set for July.

NDMC Counsel Madhu Tewatia said the civic body is free to go ahead with the auction procedures and take decisions on the terms and conditions of the auction as it is looking for more revenue from the property.

She added that the auction process will anyway take two-three months by which time the next hearing may take place.

NDMC officials said that as there is no stay on the auction process, the civic body will take up the Request for Proposal for the auction and its terms and conditions at its next board meeting, scheduled for Wednesday.

Revenue share

The property in the heart of ‘Lutyen’s Delhi’ reportedly contributes nearly Rs 150 crore to the hotel chain.

Analysts believe the increased revenue share during the extension period impacted the hotel’s profit margins. Any sharp increase in the fees may render the property unviable, they say.

Rashesh Shah, analyst at ICICI Securities, said, “The bidding process is likely to see the licence fee increase to 20 per cent of the gross revenues, beyond which it will make the property unviable for operations.” Indian Hotels will have the first right of refusal and will need to match the highest bid to retain the property. IHCL had earlier sought restraint on NDMC from auctioning the property and had asked the court to pass a “decree of permanent injunction” and prevent the civic body from conducting auction to run the hotel in its injunction suit.

Meanwhile, a Taj Hotels spokesperson said: “During the course of hearing the Delhi High Court today asked NDMC to respond to Indian Hotels Company on the injunction suit filed on April 4, 2013. The court has given them two weeks to do so. The Court will consider IHCL’s plea seeking an interim injunction on the next date of hearing… As the matter is now sub judice, we are not in a position to comment on this any further. We stand committed to the city of Delhi, all our guests, employees and partners and business continues as usual.”

Nagpur Municipal Corporation itself is not registered under LBT yet

NAGPUR: With 20 days left to register under the local body tax (LBT), only 245 of the expected one lakh traders or bodies have submitted registration forms with the Nagpur Municipal Corporation (NMC). Interestingly, the civic body itself has to register under the new indirect tax system, but is yet to complete the formality.

According to provisions in the Maharashtra Municipal Corporations (MMC) Act, NMC will have to register and get a registration number under LBT. Besides, all government departments, including divisional commissionerate, collectorate, police department etc have to ensure registration under LBT. However, NMC and government departments have been exempted from paying LBT.

The exemption has not been extended to government undertakings like MSEDCL, Mahagenco, MSRDC, VIDC, WCL, MOIL etc. These public sector undertakings will have to register and also pay LBT cess if they import any goods and materials. Similarly, Nagpur Improvement Trust (NIT) will have to register and also pay LBT.

According to NMC data, 245 traders have submitted registration forms till date. NMC has expedited the process to spread awareness among traders and other persons about registration. NMC's zone-level teams are going to shops and distributing registration forms. Some 30,000 registration forms had been distributed till Saturday.

The last date for registration is April 28. NMC will recover 10 times penalty if it finds any trader not registered under LBT. Besides, registered persons have to ensure payment of LBT cess on or before May 10 followed by the 10th of every month or be liable to pay 10 times penalty.

Municipal commissioner Shyam Wardhane and additional deputy municipal commissioner Ravindra Kumbhare are reviewing registrations and also discussing the process with various traders' bodies.

NMC assistant commissioner (LBT) Mahesh Dhamecha told TOI the registration numbers will be issued after April 10. "Expression of interest for inviting interested agencies to prepare registration software and also operate entire process has been floated. Total 21 parties purchased the tender forms. The bids will be opened on April 8," he said.

Dhamecha added that some traders organization have showed positive approach towards LBT. "Nagpur Agro Dealers Association has invited us to guide its members. A workshop was specially conducted for them. Besides, transporters association executive members came to the office and took details. NMC is ready to conduct workshops to guide traders and clear misunderstandings about LBT," he said.

Municipal SOs’ term extension challenged

A public interest petition has been filed in the High Court challenging the GO 141 dated April 1, 2013 issued by the municipal administration and urban development department extending the term of the special officers of municipal councils and corporations.

As per the notification issued by the department, the term of the special officers of 95 municipal councils and 13 municipal corporations expired on March 29. The government extended their term for a  period of six months with effect from March 30 or until the elected members assume office. Petitioners B Bhanumurthy, an advocate f requested the court to stay the operation of the impugned GO 141.
