Enforcement only after civic appeals disposed of: Karnataka

The gazette notification of the final award of the Cauvery Water Disputes Tribunal by the Union government, despite the plea of an all-party delegation from Karnataka two days ago, has come as a rude shock to the Karnataka government and efforts are on to salvage some pride with the request for a favourable intervention from the Centre.

Informed sources here told The Hindu that there was no clear-cut mechanism as such to regulate the water flow and to abide by the directions of the CWDT issued on February 5, 2007.

The Chief Minister, Jagadish Shettar, made yet another representation to the Prime Minister, Manmohan Singh, on Wednesday that the implementation and enforcement mechanism should be finalised only after all the civil appeals pertaining to the final award of the CWDT which are pending before the Supreme Court are disposed of.

Interestingly, the notification does not spell out the mechanism although the final award makes specific mention on the constitution of a Cauvery Management Board and a Cauvery Water Regulation Committee. Both the board and the regulation committee are expected to function under the direct charge of the Central Water Commission although they will comprise representatives of all the four riparian States – Karnataka , Tamil Nadu, Kerala and the Puducherry.

It should be noted that under Section 6 (A) of the Inter-state River Water Disputes Act of 1956, the Union government has to frame a scheme or schemes to give effect to the decision of a tribunal and further under each scheme an authority has also to be established largely aimed at the implementation of the award of a tribunal. Another added feature is that the constitution of such an authority and the schemes that it will oversee will have to be formulated through an act of Parliament. It is in this sense that the ball is back in the court of the Union government and in particular the Prime Minister.

Mr. Shettar told The Hindu that under the circumstances, “Karnataka is of the view that the constitution of the board will necessarily have to be delayed.”

“The Prime Minister, Manmohan Singh, has assured that the State government will be kept informed since we had urged that the final award should not be notified at the present juncture. In the interregnum the Cauvery River Authority and the Cauvery monitoring Committee should continue to function as they have been in the past particularly in the years of distress.”

53 villages to get Cauvery water

As many as 53 villages in Mysore district are now assured of getting Cauvery water with the Karnataka Urban Water Supply and Drainage Board launching a drinking water supply project, with grants from the Department of Rural Development and Panchayat Raj.

The project was implemented at a cost of Rs. 28 crore.

Cauvery water was pumped from Balamuri and a treatment plant had been constructed at Aloka near Yelwal (about 15 km from Mysore city) for supplying water through pipelines to 53 villages in Mysore and Hunsur taluks.

The villages that would benefit from the scheme include Gommatagiri, Bettadur, Halladakallahalli, Vaddarahalli, Kommegowdanakoppal, Geresanahalli, Halebeedu, Mudalkoppal, Sabbanahalli, Maidanahalli and Boochahalli (all in Halebeedu Gram Panchayat); Chikkadanahalli, Ankanahalli, Manuganahalli, Hullenahalli, Handanahalli, Boddabeechanahalli, Devarahalli and Kemppamma Hosur (all in Manuganagalli GP); Belikere, Yalachalawadi, Dallal and Dallal Koppal (all in Belikere GP); Chikkanahalli, Mallegowdanahalli, K. Naganahalli and Kallur (all in Anandoor GP); Yelwal, Chikkegowdanakoppal, Bhadregowdana Koppal, Lingadevarakoppal, Halekamanahalli Koppal, Karakanahalli and Eshwaranakoppal.

Speaking after launching the project, Chief Minister Jagadish Shettar said the multi-village drinking water supply scheme would cover the entire State.

Work launch

Earlier, the Chief Minister laid the foundation stones for an Ambedkar Bhavan near Nallappa Thana, Babu Jagjivan Ram Bhavan at Paduvarahalli, and Valmiki Bhavan at Vijayanagar II Stage.

The Chief Minister also took part in the 97th birth anniversary celebrations of Shivarathri Rajendra Swami at Suttur Math (Mysore branch), as well as the Newspaper Day function organised by the Mysore District Journalists’ Association.

UT commercial property tax rate may be hiked

The tax on commercial property in the city may witness an increase with the issue to be taken up at the meeting of the House Tax committee to be held in the coming days. The extent of the increase would be decided after a discussion at the meeting.

The members of the committee had at the previous meetings been opposing the proposed increase on the grounds that a survey of the commercial properties be conducted. Property tax on commercial property was imposed in 2004 after initial resistance from the Municipal Corporation. The Administration had assured the civic body of a matching grant if the tax was imposed.

There have been repeated reminders from the Administration for imposition of tax on commercial property as well as imposition of tax on residential property. The agenda for increasing tax on commercial property was brought up for discussion in the previous meetings of the committee as well but had been opposed by the councillors across party lines.

Instead, it had been suggested that a fresh survey of commercial property be done in order to ensure that all properties are under the ambit of taxes. It was opined that some property owners were exempted from taxes due to lack of proper survey.

A member of the committee observed, “We will have to consider the increase in the property tax on commercial property. The Municipal Corporation requires funds for various works including the recruitment of new staff. If new taxes are not imposed, this would not be possible.”

However, a section of the councillors are opposed to the proposed increase. Deputy Mayor Satish Kainth, who is a member of the committee, said that they would ask the officials to conduct a survey before the increase.

At present, some people are paying property tax while others are not. He added that instead of putting a greater burden on people who are already paying tax, the remaining section should be brought under its ambit.

The BJP, meanwhile, has already stated that it would oppose any move to either impose tax on residential property or increase the amount on commercial property. It is being opined that the Administration should release the grant that was promised earlier and has still not been given before the tax is imposed.
