BMC, PWD admit BJP structure is unauthorised

The Brihanmumbai Municipal Corporation (BMC) and the Public Works department (PWD) both agreed that the construction of the state Bharatiya Janata Party (BJP) headquarters on recreation ground (RG) in the costliest area of Nariman Point is not authorised.

The party was allotted a temporary barrack in 1980 by the PWD. However, despite having no permissions for redevelopment, the BJP is now constructing a permanent brick and mortar structure in its place.

BMC commissioner Sitaram Kunte admitted that the structure is unauthorised and was all set to be demolished after being served notice in April 2013.

“We had initiated the process of razing the unauthorised structure, but we were not given police protection,” Kunte told Hindustan Times. After this failed attempt, BJP is now seeking regularisation of the illegal structure. “Now we will have to see what has to be done,” Kunte said.

Meanwhile, BJP’s claims that they have a no-objection certificate from the PWD to construct the temporary structure were rubbished by the department.

“We have given an NOC only for internal refurbishment while keeping the roofing intact. No permanent structure can come up at that place as it is on RG,” said Kishore Patil, executive officer of the PWD.

The structure occupies 2,682 square feet of the 10,000-square foot green plot of the Jawaharlal Nehru Garden, an RTI reply received by the Nariman Point Churchgate Citizens Association (NPCCA) had revealed.

Two other structures on this plot are the state office of Janata Dal (S) and an office of the Maharashtra Tourism Development Corporation (MTDC).

The three structures occupy more than three-fourths of the 10,000 suare-foot garden. However, JD(S) and MTDC have not made any changes to their structures.

BJP, however, insisted that it was not building an unauthorised structure. “We are not building any permanent structure and have applied for the necessary permissions. I do not want to say anything further,” said BJP vice president Pratap Ahsar.

“It is a clear that if a structure is constructed on RG, it has to be demolished. We should get our open spaces back. This unauthorised structure needs to go and the land should be reclaimed,” said activist Ananhita Pandole, a resident of the area.

Another resident and member of the NPCCA, Phiroze Javeri, said that the term ‘temporary structure’ needs to be defined by the government.

“Ideally, permission for any structure on public open spaces should be strictly debarred. But if at all permission is given for a ‘temporary structure’, it should be only for a specified period not exceeding one year.”

NEW DELHI: The Urban Development Ministry is planning to involve private agencies to provide technical support to municipal bodies on issues of maintaining water supply, treating sewage and drainage systems.

Officials said that with increasing pace of urbanisation, water supply and sanitation aspects were getting greater priority but much needed to be done in these areas.

One important reason why these services were suffering is the lack of capacity that urban local bodies have in creating proper infrastructure that deals with water supply, sewage and drainage systems.

It is to help urban local bodies in these aspects that the ministry has decided to empanel firms with requisite expertise in these areas, officials said.

They said that water supply in most cities was intermittent and as per 2011 Census, only 32.7 per cent people in urban areas had sewer connections, 38.2 per cent septic tanks and while 12.6 per cent still defecate in open.

In most of the towns there is no planned storm drainage system.

They said keeping in mind the challenges of urbanisation, the ministry had decided to empanel agencies to create a pool of capacity that can provide technical support to states and urban local bodies to implement various projects, conduct studies and also impart training in the field of water supply and sanitation.

They said an expression of interest had been sought from eligible firms. Earlier the ministry has already empanelled consultancy firms for solid waste management to help states and urban local bodies.

House tax: Bylaws being prepared by MC

The UT Administration is in the process of preparing the bylaws for the collection of house tax. A communication is also being sent to the Municipal Corporation to prepare a proposal for levying the tax as per rateable value of residential property. Once decided, this will be imposed from the next financial year.

The UT Administrator recently gave his nod to the imposition of house tax in the city at the rate of Re 1 per yard per annum. Revenue amounting to Rs 2.27 crore will be collected through this. Imposition of tax is one of the conditions under the Jawaharlal Nehru Urban Renewal Mission (JNNURM).

The bylaws for imposing the tax are being prepared. These will entail the details of the tax being imposed as well as the mode of collection. UT Home Secretary Anil Kumar said that while bylaws for commercial property are already there, those for the residential property are under the process of being prepared.

"The Municipal Corporation is being sent a communication for preparing the proposal for calculation of house tax on rateable property. The new proposal has to be prepared in a period of three months. However, for this financial year, the tax will be collected at Re 1 per sq yard per annum. From the next financial year the new model will be implemented," said Anil Kumar.

The commercial property tax is collected on basis of rateable value of property. The rate at which tax on residential property is being levied will not generate much revenue.

The tax was imposed after repeated reminders from the Centre. It was stated that if the tax is not imposed, funds under Jawaharlal Nehru Urban Renewal Mission (JNNURM) will not be released.

Among the projects that are being undertaken in the city with funds from JNNURM is the construction of one-room tenements under the rehabilitation scheme.

A purchase of buses also needs to be made. The proposal for augmentation of water supply through Kajauli will be undertaken from these funds once the dispute between Punjab and Haryana over the issue is sorted out.
