Court slams MCD, dismisses 48 cases

NEW DELHI: Pulling up the Municipal Corporation of Delhi (MCD) for showing laxity in work, a trial court dismissed 48 criminal cases filed by the civic agency against alleged violators of civic law, saying even the identities of the accused have not been verified.

"These complaints reflect the sorry state of affairs in the largest civic body (MCD) of the country. I am constrained to opine that no fruitful purpose would be served by keeping these matters alive except to burden the over-burdened judiciary. Hence, these complaints are dismissed," the court said.

Metropolitan Magistrate Ajay Garg, in a common order, refused to hear the cases lodged about six years ago by the civic body under the Delhi Municipal Corporation Act against certain persons for allegedly carrying out illegal construction in their respective premises in Karol Bagh. The court came down heavily on the civic body for filing cases in a ''stereotype'' manner after a deputy commissioner of MCD informed it that addresses and other information like name of parents of the alleged violators were not available with it.

''The complaints are filed in a stereotype manner without bothering about the consequences of setting the criminal law into motion against persons whose identity cannot be established,'' the court said.

As per the record, these cases were kept pending for several years because particulars/correct addresses of the accused were not given by the complainant.

The court said coercive process, such as issuing of summons, cannot be taken against the accused in the absence of their ''established identities'' because there may be thousands of persons by the same name. ''The life and liberty of such persons would be at peril and at the mercy of police officials in case coercive process is issued at the request of the complainant,'' it said.

In a setback to the MCD, a court here has dismissed 48 criminal cases filed by it against alleged violators of civic law, saying even the identities of the accused have not been verified. "These complaints reflect the sorry state of affairs in the largest civic body (MCD) in the capital of the country. I am constrained to opine that no fruitful purpose would be served by keeping these matters alive except to burden the over-burdened judiciary. Hence, these complaints are dismissed for non-prosecution," the court said.

The court, in a common order, refused to hear the cases, lodged nearly six years ago by MCD under Delhi Municipal Corporation Act, against the persons for allegedly carrying out illegal construction in their  respective premises in Karol Bagh area. The court came down heavily on the civic body for filing cases in a "stereotype" manner after an MCD Deputy Commissioner informed it that the fresh addresses and parentage of the accused were not available with it.

BBMP to set up project management units

BANGALORE: In order to oversee projects and have transparency in the system, the Bruhat Bengaluru Mahanagara Palike (BBMP) is planning to set up project management units.

Chief minister's financial advisor K V Raju said this while speaking at a seminar organised by the Task Force for Quality Assurance in Public Constructions on Monday.

The project management units will help monitor the progress of infrastructure projects and ensure timely implementation and completion. The units will be supported by a team of transaction advisors involving technical resource personnel who will make the tendering process easier. Their involvement will force engineers to concentrate on the projects, said Raju.

The Palike will mobilise funds through government bodies or PPP and implement modern technologies.

The setting up of these units was proposed in the BBMP's 20102011 budget under the Bharat Ratna Sir M Visveswaraya Infrastructure Development Plan, he said.

Raju also said the system of shortlisting contractors through eprocurement had helped save at least `4,000 crore by entrusting works worth `40,000 crore through eprocurement.

I Ravindranath, cosecretary of the task force, urged for more power for the assistant executive engineers and other senior officials to put the projects on fasttrack. He also said agencies for thirdparty inspection should be shortlisted after checking the equipment and a proper fee must be fixed for the same.
