OSR land recovered from Guindy IT parks

CHENNAI: The Chennai Corporation recovered about 23 grounds of Open Space Reserve (OSR), from two IT parks in Guindy worth Rs 50 crore, on Wednesday as part of its on-going drive.

A team of officials led by the Corporation Mayor M Subramanian recovered about 15.32 grounds of OSR land from Olympia Technology Park and about 7.57 grounds from Tamarai Tech Park. After marking the boundaries of OSR lands Subramanian told reporters, “Both the OSR lands would be developed as recreational parks and opened for public use soon.” The Corporation had set a deadline of onemonth to recover about 700 grounds of OSR lands in 98 different places.

Both the IT parks were enjoying these OSR lands for the past several months and the Chennai Metropolitan Development Authority gave its necessary nod to recover these lands just a day ago, Subramanian said. In the past four years, the civic body has recovered OSR lands worth over Rs 3,000 crore, he added.

The civic body’s drive to recover such OSR lands from the remaining 97 places in the city is expected to gain a momentum in the coming days.

Leased BDA sites can’t be sold: HC

BANGALORE: Karnataka High Court on Wednesday directed the Bangalore Development Authority (BDA) to not to give permission to sell its sites before their lease period of 10 years expires.

Justice Rammohan Reddy issued the directive to the utility while hearing a petition. He also imposed a fine of Rs 1 lakh on the petitioner.

The petitioner, Venkatesh Naidu, a resident of BTM Layout, had sought directions to the BDA to make absolute sale deed of a BDA site he had purchased before its lease had expired.

The rules of the BDA categorically specify that someone who has been allotted a BDA land cannot sell it before the lease period of 10 years expires.

After hearing the petition, the court dismissed it and directed the BDA to follow its rules.

The petitioner had stated that he had purchased a BDA site at first phase, second stage of BTM Layout, from one N Jayalaxmi, a stenographer-cum-typist working in the Engineering section of BDA in 2006, before the land’s lease period of 10 years had expired.

The petition states that Jayalaxmi had given the power of attorney to the petitioner after accepting Rs 33.3 lakh for the land.

The petitioner argued that the prohibition to sell the BDA site before expiry of its lease period was not applicable to those who availed loans from banks to construct houses on the property.

The petitioner also sought direction to BDA to hand over the original documents of the site to him.

The court found that there is no merit in the petitioner’s argument and imposed the fine for wasting the precious time of the court.

Despite the Karnataka High Court ordering status quo on demolition near Someshwara temple in Ulsoor, the Bruhat Bangalore Mahanagara Palike (BBMP) continued with the task razing as many as 48 shops and houses to the ground.

The court order came around 4.30 pm. But, the demolition drive continued till late in the evening. The drive began early Wednesday morning.

The drive was conducted by the BBMP on behest of the Muzrai Department, as small shops which sold garments and footwear dotted the area in front of the temple.

Members belonging to minority community, spearheaded by Tipu United Front (TUF) protested the demolition drive. Later, they also protested in front of the BBMP headquarters. Demonstrators accused both the BBMP and the State government of taking advantage of the three-day holiday for the court beginning Friday. “It is shameful that such an incident has occurred in the holy month of Ramzan,” said Iqbal, a member of TUF.

However, shopowners claimed that Muzrai officers had collected Rs 900 per month, for the year 2009, just a fortnight ago. “We have been duped by the Muzrai Department, which has been collecting the rent on an yearly basis from all of us only to render us homeless without any prior notice,” lamented Aslam Pasha, who owns a ready-made garments shop.

However, the BBMP claimed that it had already sent a notice to the shopkeepers on August 31, to vacate the vicinity, as they had encroached upon the temple property and had thus become a hurdle obstructing the movement of people. In its notice, the Palike had stated that a three-day notice was issued to them for clearing the footpath. “Failing to clear the area would invite further action along with a penalty, as per the Karnataka Municipal Corporation (KMC) Act, 1976,” the notice stated.

The demolition drive was carried out under the protection of the City police and two earth movers were pressed into service.
