PMC identifies 16,000 properties not in tax net

PUNE: Over 16,000 properties, which have not been assessed for payment of property tax for a period ranging from six months to six years, were identified in the city limits during a month-long drive of the civic body.

The drive also found there were additional constructions in over 4,000 properties, but the owners failed to inform the civic administration about it. The unassessed properties are expected to mop-up an additional Rs 20 crore per year in the form of property tax. "The drive, which started in mid-November and concluded on December 31, has detected around 16,000 unassessed properties. All these properties will come under the property tax net," said Hemant Nikam, head of PMC's property tax department. The civic body will get around Rs 30 crore, including tax and penalty, as part of the drive.

He said most of these properties, including big residential and commercial complexes, are located in the fringe areas around the city. "With the income from other sources shrinking, there is greater need to get more revenue from sources like property tax," he said.

For the PMC, property tax is one of the main sources of revenue. The department handles the billing and collection of property tax on residential, commercial, plots and other types of properties - held privately or by government (state and Union) - within the municipal limits.

The city has around 7.5 lakh properties which fall in the ambit of property tax of the PMC.

Civic activists feel that lack of communication between various offices of the civic body has resulted in the delay in property assessment. "It is expected that as soon as the completion certificate is issued for a property, it comes under the property tax net. Different departments in PMC that deal with properties and construction are expected to have better coordination, the absence of which has resulted in many properties still out of the tax net," said Vivek Velankar, founder of Sajag Nagarik Manch, a citizens' group.

Nikam also admitted that the delay in assessment has resulted due to 'some systemic lacunae' such as manpower crunch. "We are planning new initiatives to increase the department's efficiency and overcome the lacunae," he said.

Property tax is charged on immovable or tangible real property, such as land, buildings and permanent improvements. Based on assessments, all property holders are expected to pay the tax. PMC assesses all residential and commercial properties situated within its limits. Property tax may also include basic house/building tax plus service taxes such as street tax, and conservancy/scavenging tax. It is collected either half yearly or annually.

The citizens, who pay the property tax before May 31, get the discount of 10%.

Civic Body to Hold Hearing for Defaulters

The Kochi Corporation has decided to call in for hearing two major   alleged defaulters of Building Regulation Act in the next Corporation council slated for January 6. The move is in connection with speeding up  actions against unauthorised constructions in the city.

“The defaulters have bifurcated the space allotted by the Corporation   without seeking permission and made a profit out of it,” said a top official with the Corporation. One of the cases involves a multi-cuisine restaurant in the city, which was  booked for unauthorised construction by the corporation earlier and the other involves a well-known Travels and Tours operator, who according to the Corporation, had occupied an office space in the Vytilla Shopping complex illegally.

The travels operator has occupied a 300 sq-feet office space in Vytilla, owned by the corporation. The civic body had earlier issued a show cause notice to the tour operator - as per the decision of the corporation council on December 12, 2012 - asking to clear the space within 48 hours and return it to the Corporation. However, as the tour operator approached the High Court, the court cancelled the Council decision and referred it to hear the applicant in its Council meeting within two months.

An inspection by the Town Planning Committee earlier had booked the multi-cuisine restaurant for illegal construction and had issued notice for its demolition. As the hotelier did not respond to the notice, the Corporation had cancelled the license of the hotel. Though the owners filed an appeal later, it was rejected by the Corporation saying it was submitted after the stipulated time to file an appeal.

The hotelier later moved to the High Court and obtained a stay against the cancellation. In its final verdict, the court asked the council to hear the applicant in its council meeting and to conclude the matter.

Drive to Clear Drain Encroachments

The BBMP is expected to initiate action to clear encroached storm water drains (SWD) from the end of this month.

G C Prakash, Deputy Commissioner (DC), Bangalore Urban, spoke about the issue on Thursday after handing over a survey report on the same to BBMP chief engineer H C Ananthaswamy.

Prakash said 44 land surveyors from the Revenue Department had prepared the report. The survey, which was intended to cover 251 villages, had already been completed in 227 villages and the remainder would be covered within 15 days, the DC said.

“Of the 650 km of storm water drains across the city, about 200 km has been encroached upon by sections of the public and influential people. Encroachments have been identified in 34 villages in Bangalore North, 39 in North taluk (additional), 77 in South, 73 in East and one village in Anekal taluk,” Prakash said.

Speaking to Express, Ananthswamy said the Palike had also documented instances of encroachment and clearance operations would begin from January-end. “We are yet to know the complete scale of encroachments. We could take up clearance of around 10 km of encroached SWDs everyday. We will also take the help of officials of Bangalore Metropolitan Task Force (BMTF). Encroachers cannot obtain a stay from the courts as the judiciary has already ordered the removal of encroachments,” he said.

Ananthswamy said it would take one year to complete the task of clearing encroachments in the outlying areas.

He said, at present, BBMP was compiling data and in the next 15 days, details about encroachments would be uploaded on its website. “This is for the information of the public. People who are buying plots or properties on encroached land can crosscheck with this data. It will also serve as a warning to encroachers,” he added.
