Patiala corporation to levy garbage collection tax

The cash strapped Patiala Municipal Corporation (MC) has decided to generate more funds to overcome its present financial condition, for this they had planned to levy garbage collection tax first time in its history. As per the proposal, from now onwards the hotels, marriage places, private and the State Government run hospitals have to dole out the money in shape of garbage collection tax.

Sources in the MC said the health branch of the corporation has come forward with this unique proposal, as it primarily deals with the collection of garbage from different points in the royal city. It is learnt that in the proposal the health branch officials have urged the commissioner of the corporation to levy tax over some of the Government as well as the private institutions like Government Rajindra Hospital, the Government Medical College, Dr Khushdeva Singh TB Hospital, the Government Mata Kaushalya Hospital, and others.

Sources added the branch further proposed that as the corporation has to dispose off this garbage by using its machinery and men so all such establishments have been ordered to pay off `5,000 per month in the shape of garbage collection tax. It is also proposed that the corporation will also charge `500 per one collection through the tractor trolley from the private schools and the offices of the multinational and other companies working in the limits of the corporation.

Besides, the corporation will charge Rs 1,000 as garbage collection tax from all the hotels and restaurants set up in 100 sq yards area and Rs 3,000 from up to 500 sq yards, whereas all the marriage palaces doing business in the municipal limits of the city have to be instructed to pay `10,000 per month for the collection of their garbage by the MC staff.

When contacted, Commissioner of the corporation, Manjit Singh Narang said he had received this proposal and he had taken up this with the Mayor Ajitpal Singh Kohli, who liked the proposal as it will bring money for the corporation.

Narang added that this proposal will be forwarded to the General House to get the approval and we are hoping that it will get approval in the next general house meeting.

‘We can levy cess on defaulting developers’

BANGALORE: The city corporation has, before the Karnataka High Court, defended its decision to levy cess on land owners who do not leave open space on their plots after construction.

The Bruhat Bengaluru Mahanagara Palike (BBMP) issued a circular on June 9, 2010 that those constructing building on less than 20,000 square metre had to leave 10 per cent the land as open space.

As per the circular, land owners who did not leave open space had to pay 10 per cent of their land value as cess.

Confederation of Real Estate Developers’ Association India (Karnataka) had challenged the circular in the High Court. It contended that the BBMP had no legislative competence to issue such a circular. Also, the petition stated that the circular was contrary to the procedure of Town and Country Planning Act.

In its detailed objection filed in the court, the BBMP said the circular was in accordance with the Karnataka Town and Country Planning Act and Karnataka Municipal Corporations Act, 1976.

The Palike said as per the revised master plan 2015, developers had to leave 10 per cent of the land as open space to maintain park and five per cent of land for civic amenities. The Palike said the yardstick was applicable on non-residential buildings too.

The BBMP said private land owners were not leaving open space and thus it decided to collect cess from them. The Palike said the fund thus collected would be utilised to provide open space and parks. Justice Ashok B Hinchigeri heard the petition and adjourned the hearing to next week.

HC asks Wipro to pay tax

Karnataka High Court on Friday dismissed the writ petition of Wipro Technologies, which challenged the levy of four per cent value added tax of Rs 22 crore to export software.

While dismissing the petition, Justice Ashok B Hinchigeri suggested the petitioner to approach the appellate authority of commercial taxes. The court said the petitioner must deposit 50 per cent of the tax amount before the appellate authority while approaching it.

Wipro had developed software for different companies and exported the same but had failed to produce required details to commercial taxes department.

The department, on October 26, 2010, levied Rs 22 crore as Value-Added Tax on the company. Wipro had challenged the demand notice of the department. The department has stated that the sale of software amounts to sale of goods and it come under the purview of sales tax.

Call for unified struggle on garbage tax

VIJAYAWADA: Only a unified struggle against the collection of tax on garbage lifting will force the State government to stop its implementation all over the state, opined speakers here at a round table on Friday. The meeting, convened by the Tax Payers Association (TPA), termed the levying of user charges on garbage lifting “undemocratic and unlawful”.

Initiating the discussion, TPA president V. Sambi Reddy said that the Corporation was collecting conservancy tax, which was part of property tax for maintaining sanitation in the city. Collection of a separate amount for the same service will only burden the people, and, hence, the proposal should be scrapped immediately, he said.

TPA secretary M.V. Anjaneyulu said that the State government issued GO 973 directing the Municipal Commissioner to take necessary steps for collecting user charges on municipal solid waste management. The city was chosen for experimenting on this. If the tax collection became a success here, the State government will implement it all over the State, he said.

Former floor leader of the CPI (M) in the VMC general body Ch. Babu Rao termed the garbage tax as a new tool to loot the public money by the Government. The servces being offered by the urban local bodies had not been improved but they have been mooting new tax proposals.
