Urban villages, unauthorised colonies get tax exemption

In a strong message to the Delhi government, the standing committee of the MCD on Wednesday passed a resolution for exempting areas under urban villages and unauthorised colonies from property tax and directed the municipal commissioner to stop sending notices in this regard with immediate effect.

The Municipal Corporation of Delhi’s (MCD) standing committee under section 177 of the Delhi Municipal Corporation (DMC) Act passed a resolution to the effect that no property tax would be collected from areas under unauthorised colonies and urban villages.

The committee also passed a condemnation notice under section 74 of the DMC Act against the Delhi government.

The civic body has been in conflict with the Delhi government over the issue of property tax in these areas with both the agencies blaming each other for not taking relevant steps.

After Delhi’s finance minister AK Walia criticised MCD for collection of property tax from unauthorised colonies and urban villages, the civic body, on Tuesday, hit back demanding issue of notification by Delhi government for exemption from property tax in these areas.

“The MCD has to finalise the layout plans but before that Delhi government has to finalise the boundaries, which has not been done,” standing committee chairperson Yogender Chandolia had said on Tuesday.

Earlier on Monday, Walia, while replying on property tax issue on these areas, had said: “The MCD has been collecting property tax from 9 lakh dwelling units whereas they have no interest in providing civic services.”

New Delhi:  Property owners in urbanised villages of Delhi will no longer need to pay property taxes. The MCD on Wednesday passed a resolution in which they also directed the Municipal Commissioner neither to collect property tax from such areas nor send any tax demand notices to residents there. The move by the BJP-ruled MCD came as a result of Finance Minister A K Walia’s comments two days ago condemning the MCD for sending property tax notices to villages.

On Wednesday, the MCD Standing Committee moved a motion that properties in unauthorised colonies be exempted from House Tax till their regularisation while in rural and urbanised villages, original owners or heirs of properties, who are making personal use of such units, should also be exempted from tax. The committee also moved a condemnation motion against Walia for his comments.

Standing Committee Chairman Yogender Chandolia said instead of collecting tax from villages, the MCD will prefer to widen the tax net to increase revenue. “Among 35 lakh properties in Delhi, only nine lakh are paying house tax,” he noted. “The Delhi government is not taking any decision over MCD resolutions on reducing the age of senior citizens from 65 years to 60 for the purpose of rebate in property tax and increasing the rebate of 30 per cent to women and physically challenged for self-occupied properties from 100 sq m to 200 sq m,” the BJP leader said.

MCD to forgo property tax in villages, illegal colonies

NEW DELHI: The Municipal Corporation of Delhi has decided not to levy property tax on property owners in rural areas, urbanised villages and unauthorised colonies from now onwards.

A meeting of the MCD Standing Committee passed a resolution in this regard and also directed the Municipal Commissioner neither to collect property tax from such areas nor send any tax demand notices to property owners there.

The BJP-ruled MCD's move comes against the backdrop of recent motion passed by the Delhi Assembly that properties in unauthorised colonies be exempted from house tax till their regularisation while in rural and urbanised villages, original owners or heirs of properties who are making personal use of such units should also be exempted from tax. During the discussion on the motion, ruling Congress MLAs had said the MCD has issued tax notices to many people in such localities.

Dubbing the Assembly motion as a “political move”, MCD Standing Committee chairman Yogender Chandolia said: “Since the last three years we have passed several resolutions stating that no property tax should be levied in unauthorised colonies, urbanised villages and rural areas. But the Delhi Government did not forward our resolution to the Central Government neither then nor when it was in power in 2004 so why is it passing a motion on it now if not to meet political motives.”

According to Mr. Chandolia, since over 1,600 unauthorised colonies have no proper provision for water, electricity and civic services the BJP-ruled MCD wanted that the Delhi Government should first pass their layout plans and regularise them so that the civic body can begin providing civic services there and only thereafter levy property tax from them.

“However, without giving any regularisation certificates to these colonies the Delhi Government has passed the motion in the Delhi Assembly. The MCD Standing Committee condemns this motion and it has passed another resolution on Wednesday directing the Municipal Commissioner to issue a notice that no property tax would be recovered from these areas,” he added.
