17 lakh fine for not vacating property

BANGALORE: The Karnataka High Court took serious exception to the violation of a court order and slapped Rs 17 lakh fine on 68 people for not vacating the property of the City Municipal Council in Madikeri.

While allowing a contempt petition, the division bench headed by Chief Justice J S Khehar directed the occupants, all respondents in the petition, to pay a fine of Rs 25,000 each. The court directed that out of the Rs 25,000 paid as fine, Rs 10,000 would go towards the Karnataka State Bar Council, `10,000 towards the advocates’ association and Rs 5,000 to Madikeri Municipal Council.

“We will not tolerate such kind of disobedience of the court order,” the judge said.

Case quashed against miracle buster

The HC has quashed a criminal complaint filed against Hulikal Nagaraj, a miracle buster and school teacher. Allowing the petition filed by Nagaraj, Justice Nagmohan Das quashed the complaint filed against him.

Madikeri police filed a case against Nagaraj, a national awardee in 2006, after he claimed that the ‘Jyothi’ seen at Shabari Aiyappa Swamy Temple was not due to supernatural powers. The case was registered on the grounds that the allegation hurt the sentiments of Hindus.

BWSSB commissioner asked to file affidavit

The High Court directed the BWSSB commissioner to file an affidavit on the appointments made to the posts of junior assistant, meter reader and second divisional assistants. Hearing the petitions challenging the appointments, the court directed the commissioner to file the affidavit by Wednesday.

The court has already stayed the selection list. The petitioner contended that the selections  were not in accordance with the law.

VISAKHAPATNAM: A delegation of floor leaders of Greater Visakhapatnam Municipal Corporation led by Mayor Pulusu Janardhana Rao to represent to the government to rollback the ‘steep hike' in property tax will leave for Hyderabad on Monday evening.

“An appointment has been fixed with the Chief Minister for Tuesday morning. Municipal Administration Minister Anam Ramnarayana Reddy will be away at Kadapa on Monday.

Though we wanted to meet the Chief Minister on Monday we had to postpone it in view of the minister being away,” Mr. Janardhana Rao told The Hindu on Sunday.

The feeling among people that the tax increase was abnormal and would be a burden would be represented to the Chief Minister urging him to reduce it, the Mayor said.

Political parties have been agitating against the hike ever since the corporation has started serving special notices informing about the tax hike.

The TDP had organised relay fasts for nine-days on the tax hike and suspended following the fixing of date for a meeting with the Chief Minister.

Demand for rollback

CPI(M) has been agitating for a rollback while the CPI organised protests against the hike.

The BJP also held a protest and submitted a memorandum to the authorities.

CHANDIGARH: House tax is back in Haryana. Two years after Haryana CM Bhupinder Singh Hooda announced the abolition of house tax, his urban local bodies minister announced the new house tax policy in the assembly on Monday. The new avatar levies a "token tax'' on houses up to 250 square yard and a formula for those above this.

Haryana urban local bodies minister Mahender Pratap Singh said a token amount of Re 1 per square yard per annum for those dwelling in housing units below 250 square yard is the high point of the policy targeting to benefit lakhs of house tax assessees across the state.

Tax for all houses above 250 square yard will be calculated through a formula that will factor in aspects like worth of the land, cost of construction and rental value.

A number of thoughts went into levying of house tax, including the fact that a blanket exemption implies that even the affluent sections were left out of the house tax regime, "which cannot be accepted as a fair principle''. The exemption also meant that a large number of properties were not being recorded in municipal documents.

The minister told the assembly that the house tax will based on self assessment. It will be on unit area method, that is, depending on the built up plot area and the rate of tax will be realistic to ensure voluntary compliance. Assessees will have the option to deposit the tax in any nationalized bank.

"There is heavy penalty for defaulters. This will act as a deterrent. A formula is being worked out for this,'' said urban local bodies secretary Raj Kumar.

"This tax system is based on self assessment. In India, all taxation, like income tax, is self assessed, so why not house tax. And, we hope to cover all houses with token tax scheme,'' added Kumar.

Hooda's claim two years ago of doing away with house tax fell flat after the Union ministry of urban development stopped the matching grants sanctioned under Jawaharlal Nehru Urban Renewal Mission.

Following this, the CM had constituted a three-member committee headed by Singh to suggest measures for re-imposition of house tax in the state.
