No stay on Local Body Tax, but HC issues notice to Maharashtra, NMC

NAGPUR: In a decision along expected lines, the Nagpur bench of Bombay high court on Tuesday declined to grant stay on the Local Body Tax (LBT) as demanded by traders. A division bench comprising Justices Bhushan Dharmadhikari and Arun Chaudhari cited principal bench's directives while hearing similar pleas in Mumbai.

However, the court issued notices to respondents - Urban Development Department and Nagpur Municipal Corporation (NMC) - before admitting the petition. Government pleader Nitin Sambre and senior counsel Chandrashekhar Kaptan waived notices for urban development department ( UDD) and Nagpur Municipal Corporation (NMC) respectively.

The court was hearing five petitions, which were later clubbed. The petitioners include mayor Anil Sole and 11 other corporators and traders, Vidarbha Taxpayers Association (VTA) with Tejinder Singh Renu, Nagpur Chamber of Commerce Limited ( NCCL), Nag-Vidarbha Chamber of Commerce (NVCC), and BSP leader in NMC Murlidhar Meshram with corporator Kishor Gajbhiye. Deven Chauhan and Harnish Gadhia were counsels for the petitioners.

Last week, the principal seat vacated its interim stay while hearing 19 pleas, thus paving the way for implementation of LBT in place of the 150-year-old octroi across the state. Nonetheless, Municipal Mazdoor Union (MMU) is planning to approach the Supreme Court in this regard. The LBT, imposed to check massive corrupt practices and ease traffic congestion at octroi posts, came into effect from Monday at Nagpur, Mumbai, Pune, Pimpri-Chinchwad, Thane, and Navi Mumbai municipal corporations.

The petitioners contended that octroi is the major source of income for NMC to meet its regular expenditure and there was no need for LBT since VAT already existed. However, on February 25, 2010, the government framed rules for LBT in the name of Bombay Provincial Municipal Corporation (Local Body Tax) Rules 2010. Exactly two years later, the government issued a notification directing the civic body to commence LBT collection from April 1. In the intervening period, other benches of this court stayed the government action and permitted various municipal corporations to levy octroi. Even the petitioners had approached the government demanding similar relief, but all their efforts went in vain, prompting them to approach the judiciary.

The petitioners said the limit for registration for LBT is turnover of sales/purchase of Rs5,000 or more during a year. However, format of LBT is far more cumbersome than octroi. They explained that while levying octroi, no special record keeping is required as once the material enters city limits, octroi is paid on its cost and the issue ends there itself. But in LBT, separate book keeping, compilation of data, filling up of forms and timely returns is needed, followed by assessment, which may also attract chances of penalty, interest, and payment of fees to professionals.

March over, but AMC budget still not passed

ALLAHABAD: Concern has been expressed over the main budget and the revised budget of the Allahabad Municipal Corporation not being passed. This has raised question over the present management of the affairs of the AMC without seeking the approval from Sadan and the executive council.

Corporator Athar Raza Ladley said this is probably the first time in the history of AMC that budget has not been passed in March. It has been the past tradition of AMC that main budget is presented before the executive council till February 15 and is also passed in Sadan by March 31. But this time both the Sadan and the executive council have been ignored as the budget has not been passed till date.

Ladley alleged that municipal commissioner has not shown any interest in the passing of the main budget. He also alleged that all the works being undertaken by Allahabad Municipal Corporation are against the law as it does not have the approval of Sadan.

Ladley said even the review budget for 2012 should have been passed before October. The review budget of 2012 was neither placed on the floor of Sadan nor before the executive council.

The corporator has also written to chief minister Akhilesh Yadav and state urban development minister Azam Khan in this regard.

Corporator Shiv Sewak Singh has also flayed the Allahabad Municipal Corporation for not passing the main budget even as March has passed. He said that officers are lest bothered to adhere to the rules and regulations of the AMC.

Talking to TOI, AMC accounts officer TN Mishra said, "As the entire AMC administration was busy during the Kumbh mela, sufficient time was not found for the preparation of the budget." He added that as Parliament and UP Vidha Sabha session were on in March, it was not possible to convene the Sadan meeting of AMC. He assured that the main budget may be put before Sadan on April 8.

NMC to identify land for Thackeray memorial

NASHIK: The Nashik Municipal Corporation (NMC) has decided to identify land for the proposed memorial of Sena chief late Bal Thackeray. It will also visit the proposed site of the new museum project in the city for the purpose. The decision to this effect was taken at the meeting of all party group leaders, called by the city mayor Yatin Wagh on Monday.

Wagh said, "The group leaders suggested the proposed site of the museum in prabhag no. 22 for the memorial. We will soon visit the site. It was also been decided to get the list of the plots of the municipal corporation and take a decision thereafter."

The mayor added, "The memorial will include an art gallery, his memorabilia and other projects. The work of the memorial will begin once the land is identified."

The meeting was attended by Sena group leader Ajay Boraste, leader of the opposition Sudhakar Badgujar of the Sena, NCP group leader Vinayak Khaire, MNS group leader Sujata Dere, leader of the house Shashikant Jadhav and group leader of Shahar Vikas Aghadi, Gurumit Bagga. Leader of opposition Sudhakar Badgujar said, "We urged the mayor to build the memorial at the proposed site of the museum in prabhag no. 22 instead of seeking list of plots from the NMC."

The NMC general body meeting on December 19, 2012 had given its nod to the memorial in the city.
