Masterplan for Mohali challenged in court

Chandigarh: The Punjab and Haryana High Court has issued notices to the state and the Greater Mohali Urban Development Authority (GMADA) on a public interest litigation, challenging the masterplan for the district. The petition was filed by Kamal Kumar Sawhney and a few residents of Mohali, who run their businesses in village Balongi, Daon and Ballomajra on the right side of the highway towards Kharar.

The petitioners said they were aggrieved by their land being shown as residential instead of mixed use, as it was earlier shown according to the 2006 masterplan. The planning of the area is to be undertaken by the District Planning Committees and not by the PUDA or GMADA. The PIL has demanded corrections to be made in the masterplan dated June 3, 2009 in which a large track of land has been changed from mixed land use to residential use in villages Balongi and Ballomajra.

A division bench comprising Chief Justice Mukul Mudgal and Justice Jasbir Singh issued notices to the opposite parties and asked the state and GMADA to explain why the implementation of GMADA not be stayed. The PIL was argued by senior advocate H S Grewal.

Mumbai: A day after staying the Shivaji Park renovation project, the Bombay High Court today allowed the BMC to put the finishing touches on a mural depicting the coronation of warrior king Shivaji.

The order came as partial relief to the Shiv Sena, ruling party in the BMC, and the jubilant party went about its plans to unveil it on Friday.

The court had stayed the beautification project following a public interest litigation challenging the process of awarding contracts. A division bench of Justice F I Rebello and Justice Amjad Sayed, by way of an interim order, had also stayed the construction of the mural.

The BMC today moved the court saying the mural was already complete and sought permission to polish it and level the ground in front, so that it could be unveiled to mark the state’s golden jubilee.A division bench of Justice J N Patel and Justice S C Dharmadhikari refused to entertain the appeal and directed the corporation to approach the bench that had passed the order yesterday.

The court, however, made it clear that today’s relief was subject to final verdict on the PIL.

Durgesh Warty, a city resident, in the PIL has alleged that the mural was commissioned without inviting tenders.

The next hearing is scheduled for May 5.

Civic body gets Rs 47crore for work done under JNNURM

Pune: The Pune Municipal Corporation’s (PMC) efforts to get the pending funds from the state government under the Jawaharlal Nehru National Urban Renewal Mission (JNNURM) yielded results on Thursday when the government released Rs 47 crore.

“The development work under JNNURM was complete but the government had not given the money. The release of Rs 47 crore has ensured that there are no pending dues from the government,” said standing committee chairman Arvind Shinde.

The amount received includes Rs 26.44 crore spent on Commonwealth Youth Games and Bus Rapid Transit System (BRTS), Rs 4.5 crore for river development, Rs 33 lakh for subway on Ahmednagar Road and Rs 16.20 crore for purchase of buses.

The PMC has so far completed work worth Rs 725 crore that was enlisted in the detailed project report (DPR), Shinde said adding the expenditure on the work under JNNURM so far have been Rs 1,100 crore. Shinde said the credit for getting the pending dues goes to Congress as the party leaders were continuously following it up.

Shiv Sena legislators Mahadeo Babar and Chandrakant Mokate said they too had raised the issue of pending dues in the state Assembly wherein the government has assured to disburse the fund. “The Congress should not take all credit as there was contribution from leaders of all political parties,” they said.

Meanwhile, the standing committee members have decided to undertake visits to the work being done under JNNURM.

“There have been complaints of contractors keeping the work incomplete. We have been working hard to get the proposals approved from the state government and also continuously follow up to get the money for the projects. It was time for us to take stalk of the work being done,” said corporator Ujjwal Keskar.

There is need to be more careful while spending money received by the civic body under JNNURM, he said adding that it recently came to focus that PMPML had made changes in the norms approved in the detailed project report for purchase of buses.
