Lokayukta notice to Minister, MLAs for illegal structures

Delhi Lokayukta on Tuesday issued notices to 35 public functionaries, including a Minister of Delhi Government and other MLAs and Municipal Councillors, following a complaint that 60 public functionaries are alleged to have unauthorised construction on their properties without getting any sanction plan or permission. The list of the public functionaries includes Delhi Finance Minister AK Walia, Dr. Harsh Vardhan, Amrish Singh Gautam, Naseeb Singh and Narender Nath. Issuing the notice, Lokayukta Justice Manmohan Sarin said, “”Prima facie a case under section 7 read with section 2 (b) of the Delhi Lokayukta and Upalokayukta act for inquiry into the allegations made by the complainant is made out. Issue notice to the Respondents (35 public functionaries) of the complaint.” Lokayukta has fixed December 10 as the next date of hearing.

Lokayukta issued notices to Finance Minister AK Walia, MLAs including-Harsh Vardhan, Amrish Singh Gautam, Anil Kumar, Naseeb Singh, Dr Narender Nath, Bijender Singh, Asif Mohammed Khan, Bharat Singh and Municipal Councilors including BB Tyagi, Anjana Parcha, Deepa Jain, Deepika Khullar, Dr Harishankar Kashyap, Indu Mishra, Lata Gupta, Azad Singh, Bhupender Gupta, Jai Kishan Sharma, Dr Chandi Ram, JP Sharma, Amrit Lal Singhal, Kanchan Maha Narayan Mishra, Ajit Singh Chaudhary, Duli Chand, Anita Sharma, Khurram Iqbal, Krishan Murari Jatav, Chaudhary Brahm Prakash, Darshana, Hemchand Goel, Jagdish Mamgain, Jamaluddin, AA Deepak Chaudhary and Krishan Kumar.

Municipal Corporation of Delhi (MCD) filed the report after Delhi Lokayukta Justice Manmohan Sarin directed the MCD Commissioner KS Mehra to submit a report with regard to sanction of the plans in respect of the properties of 60 public representatives in February this year. Lokayukta has sought further information about the properties of 23 public functionaries where they have carried out unauthorized constructions. The places where the said public functionaries carried out unauthorized constructions includes Laxmi Nagar, Krishna Nagar, Shahdara, Gazipur, Uttam Nagar, Seelampur, Tagore Garden, Vikaspuri, Subhash Nagar, Tilak nagar, Hari Nagar, Patel Nagar, Mehrauli and Malviya Nagar.

In the status report, MCD mentioned that Dr. Walia’s property at Laxmi Nagar was regularized in 2007 and it has non-compoundable area of 41.81 sq. metres which is required to be demolished as it cannot be legalized even by paying a penalty. Justice Sarin’s order came during an inquiry into whether a house owned by Vivek Vihar ward Congress councilor Preeti Behn at Jhilmil Colony in East Delhi is on encroached land. Under the circumstances, Behn wrote to Justice Sarin on January 12 listing the names of 60 legislators and councilors who she claimed had carried out unauthorised construction in their houses.
