‘Petitioners had not been able to prove ownership of the land'

The Delhi High Court on Thursday cleared the decks for demolition of unauthorised temporary structures on a Delhi Development Authority land in North Delhi, dismissing the claim of a bunch of petitioners on the land.

Dismissing the petition filed by a group of so-called residents of “Bhagat Singh Park Extension” in North Delhi, Justice S. Muralidhar said the petitioners had not been able to prove the ownership of the land.

The petitioners submitted that the residents of the colony had purchased the land from the peasants of the nearby Siraspur village, and it had been included in the list of the unauthorised colonies prepared by the Delhi Government for regularisation.

They also claimed that they had written to the Government about the status of the colony and the latter had issued a provisional certificate to them to this effect.

However, counsel for the Authority submitted that the land had been purchased by it and its owners had alre-ady been paid compensations.

Counsel further submitted that the Authority had planned to build a hospital, shift the timber market and build houses for the economically weaker section of society on the land.

The Authority also informed the Court that there were only some temporary structures on a portion of the land and about 90 per cent of it was vacant.

The Authority had earlier several times demolished the temporary structures but the encroachers had rebuilt them each time.

Justice Muralidhar dismissed the petition saying that there was a contradiction in the submissions of the petitioners that they had purchased the land and at the same time they said that it was an unauthorised colony.

Besides, the scheme for regularisation of the listed unauthorised colonies did not mean regularisation of empty lands, Justice Muralidhar observed.

    Encroachments in parking areas to be cleared in April

    Hubli Dharwad Municipal Corporation Commissioner K.V. Trilokchandra has said the corporation will conduct a drive in April to clear encroachments in parking areas.

    Speaking to presspersons here on Tuesday, Mr. Trilokchandra said that initially the corporation would focus on the central business district.+

    He said the corporation had a list of 408 commercial buildings that had violated building bylaws.

    The list included buildings not having building permission and completion certificates.

    “Subsequently we asked the officials to identify buildings in the central business district that had violated building bylaws, including not maintaining parking areas,” he said.

    He said that 45 buildings in the central business district had violated building bylaws and had encroached upon parking areas. Residents were put to hardship because of this, he said.

    “At present, we are tied up with other work, including Census work. We will begin the process of clearing encroachments in the first week of April,” he said.

    Meet to discuss drinking water shortage planned

    A meeting of the Kerala Water Authority officials and councillors will be held at the Council hall on January 17. Councillors will get a chance to raise their complaints at this meeting.

    The meet will discuss the possible ways to find solutions to the shortage of drinking water in the city.

    Answering the issue of unauthorised hoardings in the city, Mayor Tony Chammany said that all unauthorised hoardings and display boards in the city limits would be removed with immediate effect. The Town Planning Officer has been entrusted with this task.

    The agency that was given contract for maintenance of the streetlights has made a default of Rs.18 lakh and the contract has been nullified. Tenders will be invited for new contract for a period of two months soon, he said.

    Special numbers

    The resolution to issue special numbers to those staying in puramboke land to issue electricity connection as part of complete electrification project of the State government caused much debate. Finally the resolution was passed after Mr. Chammany said that those eligible can apply along with the certificate issued by division councillor concerned.

    N. Venugopal, M. Anil Kumar, K.V. Manoj, K.J. Sohan and Shyamala S. Prabhu were among those who participated in the discussions.

    There were discussions about the outstanding dues to contractors.

    To this, Mr. Chammany said that works were not executed during the tenures of previous councils according to estimated budget and implementation cost escalated many fold. This has led to the outstanding dues and a collective effort, instead of blaming each other, is required to improve the situation, the Mayor told the Council.

    A meeting of the Urban Poverty Alleviation Department (UPAD) staff will be convened soon to discuss the implementation of various projects. Complaints about functioning of the Janaseva kendras will also be looked into.
