Lokayukta notice to Minister, MLAs for illegal structures

Delhi Lokayukta on Tuesday issued notices to 35 public functionaries, including a Minister of Delhi Government and other MLAs and Municipal Councillors, following a complaint that 60 public functionaries are alleged to have unauthorised construction on their properties without getting any sanction plan or permission. The list of the public functionaries includes Delhi Finance Minister AK Walia, Dr. Harsh Vardhan, Amrish Singh Gautam, Naseeb Singh and Narender Nath. Issuing the notice, Lokayukta Justice Manmohan Sarin said, “”Prima facie a case under section 7 read with section 2 (b) of the Delhi Lokayukta and Upalokayukta act for inquiry into the allegations made by the complainant is made out. Issue notice to the Respondents (35 public functionaries) of the complaint.” Lokayukta has fixed December 10 as the next date of hearing.

Lokayukta issued notices to Finance Minister AK Walia, MLAs including-Harsh Vardhan, Amrish Singh Gautam, Anil Kumar, Naseeb Singh, Dr Narender Nath, Bijender Singh, Asif Mohammed Khan, Bharat Singh and Municipal Councilors including BB Tyagi, Anjana Parcha, Deepa Jain, Deepika Khullar, Dr Harishankar Kashyap, Indu Mishra, Lata Gupta, Azad Singh, Bhupender Gupta, Jai Kishan Sharma, Dr Chandi Ram, JP Sharma, Amrit Lal Singhal, Kanchan Maha Narayan Mishra, Ajit Singh Chaudhary, Duli Chand, Anita Sharma, Khurram Iqbal, Krishan Murari Jatav, Chaudhary Brahm Prakash, Darshana, Hemchand Goel, Jagdish Mamgain, Jamaluddin, AA Deepak Chaudhary and Krishan Kumar.

Municipal Corporation of Delhi (MCD) filed the report after Delhi Lokayukta Justice Manmohan Sarin directed the MCD Commissioner KS Mehra to submit a report with regard to sanction of the plans in respect of the properties of 60 public representatives in February this year. Lokayukta has sought further information about the properties of 23 public functionaries where they have carried out unauthorized constructions. The places where the said public functionaries carried out unauthorized constructions includes Laxmi Nagar, Krishna Nagar, Shahdara, Gazipur, Uttam Nagar, Seelampur, Tagore Garden, Vikaspuri, Subhash Nagar, Tilak nagar, Hari Nagar, Patel Nagar, Mehrauli and Malviya Nagar.

In the status report, MCD mentioned that Dr. Walia’s property at Laxmi Nagar was regularized in 2007 and it has non-compoundable area of 41.81 sq. metres which is required to be demolished as it cannot be legalized even by paying a penalty. Justice Sarin’s order came during an inquiry into whether a house owned by Vivek Vihar ward Congress councilor Preeti Behn at Jhilmil Colony in East Delhi is on encroached land. Under the circumstances, Behn wrote to Justice Sarin on January 12 listing the names of 60 legislators and councilors who she claimed had carried out unauthorised construction in their houses.

ROURKELA:  Rourkela municipal administration yesterday cleared encroachments along the drain line and sidewalks between Bisra square and Madhusudan square.  Accompanied by three platoons of police, the civic body personnel removed encroachments from the footpaths which was necessary for repair or cleaning of public drains and would also make smooth passage to pedestrians. Encroachers, who were earlier slapped notices tried to raise protest, but finally surrendered meekly. 

Rourkela ADM Sachin Ramchandra Jadav, municipal executive officer and engineer BK Swain and Manoranjan Mishra respectively were present.

‘Speed up encroachment clearance’

Stressing on the need to act fast to clear the illegal encroachments in the district, in keeping with the orders of the Supreme Court, Deputy Commissioner Harsh Gupta directed the officials to take necessary steps towards the same.

He was speaking at a meeting of officials attached with Mysore City Corporation (MCC), Zonal Offices, and revenue department held at Mysore Urban Development Authority, here on Monday.

As per the orders, district administration has been instructed to start works relating to clearing illegal encroachments in public places, including places of worship, by or before December 10, and complete the operation by December 31.

A meeting with Chief Secretary of the state, was held recently, with regard to the state’s take on the operation. “We were told that the state has no objections whatsoever with respect to the order of the Supreme Court, and gave a go-ahead regarding the same,” he said, according to a press release.

Hence, officials concerned need to get cracking with the task ahead and take necessary steps within 2-3 days, the DC said. “The officers need finalise details and submit the plan to the commissioner, for further action,” he added.

Criminal case

In case, persons or organisations who have encroached the land are willing to clear it voluntarily, they should do so within one week’s time. Failing this, officers have to act stern and clear them without further delay. Statues or objects of worship, if any, are present on the encroached space, should be extricated carefully, while exercising due respect, and be preserved with care.

Officers can seek additional police force in order to carry out out these tasks, whenever needed. Priority clearance should be carried out on places used by public - such as roads and parks. Criminal case would be filed against officers who fail to perform their duties, with regard to this drive.

 Encroachments in private lay outs, CA sites and parks in those vicinities, should also be cleared without further delay, he stated. Care and due diligence must be exercised in case of heritage buildings or structures more than a century old being present in the encroached area.

“Officers should conduct themselves in such a way that there should be no doubt or anxiety in the minds of general public regarding this operation.

Do seek guidance from higher officers when in doubt, and under no circumstances, should the people be provoked while doing your duty,” he advised the officers.
