KMC removes 203 encroachments

KANPUR: As many as 203 encroachments were removed by a team of Kanpur Municipal Corporation ( KMC) officials as part of an anti-encroachment drive on Thursday.

The municipal corporation team led by KS Awasthi, deputy city commissioner zone- 4 started its campaign from Ashok nagar crossing and removed illegal constructions from Harsh Nagar petrol pump, Brahmanagar crossing, 80 feet road, Kamla Nehru Park, Nehru Nagar electronic market, P Road, Lenin Park and Gandhi Nagar Park.

During the drive, the squad demolished 7 shanties, 27 tarpaulin sheds, and 11 bamboo sheds besides removing 17 kiosks, 127 banners, 14 tables, chairs and benches.

Health camp: Municipal corporation Kanpur Nagar will organise a free homeopathic camp at Mohd Ali park in Chamanganj on April 21, 2013.

According to city health officer Dr UP Agarwal, the local corporator had sought a health camp in the area and his representation was accepted. Two homoeopathic doctors Ghanshyam Naresh and Shabbir Ahmad had been appointed by him for the camp, that would open at 9 am, he said.

Budget discussion: House of municipal corporation will discuss the budget for the year 2013-14 on April 27, 2013. The executive committee has already cleared the budget of Rs 171 billion. The house would discuss the various provisions of the budget and thereafter development work would begin in current financial year, according to municipal commissioner.

Meanwhile, corporators are once again joining hands to raise the issue of house tax in the house.

Tendors: Municipal corporation Kanpur nagar officers are baffled with the strategy of contractors. For cleaning of 160 drainage of the city, contractors had not make bid for 34 nullahs. The contractors who had made bid for remaining nullahs had quoted 25 to 30 percent less rates than stipulated one.

According to the chief engineer of municipal commissioner it was disturbing that contractors had quoted 25 to 30 percent less rates in their bids. It would directly hit the quality of work therefore no final decision had been taken so far.

10 illegal structures razed by UT in demolition drive at Kishangarh

High drama was witnessed on Thursday during a demolition drive by the UT Estate Office and the Land Acquisition Office at Kishangarh. Chandigarh BJP president Sanjay Tandon, who went to the demolition drive along with several party workers, alleged that this was happening on the behest of the ruling Congress.

During the drive which started in the morning, the team demolished about 10 illegal warehouses which were constructed on the government land.

Meanwhile, an official of the Estate office said that the demolition drive was carried out peacefully in Kishangarh and a total of 10 illegal warehouses were demolished. The government land was acquired for the development of IT Park Phase III. The warehouses had been constructed by encroaching upon the government land.

"No prior written notice was handed over to us in the shop. All of a sudden we saw bulldozers coming and no time was given to us to vacate the place," said Rajesh Kumar, who, with some others, used to make brooms at a property which was demolished.

"No prior warning or information was given to us as two bulldozers razed the property at which we were working. We were not even allowed to vacate the place," said Kailash, who is an employee in one of the buildings which was demolished.

BMC gets lever to bypass civil courts before demolition drives

BMC plans to put to good use an amendment it quietly introduced in Mumbai Municipal Corporation (MMC) Act last year to take tough action against illegal constructions.

The 515 (a) amendment lets the civic body demolish illegal structures without intervention by way of stay orders promoters of illegal constructions normally obtain from city civil courts. To effect to the amendment, BMC has empowered 64 designated officials — executive engineers — to function as a demolition squad. These officials are also protected from intervention by senior BMC officials, including deputy and assistant municipal commissioners.

There will be only two-three wards under the jurisdiction of each of these 64 designated officials, ensuring better action. They will not only undertake demolition work in the 227 corporator wards but also closely monitor and identify illegal and unauthorised buildings.

"Earlier, action against illegal structures would get mired in legal tangles as most people would get stay orders from civil courts. This amendment seeks to stop this racket," said BMC commissioner Sitaram Kunte.

Before the amendment, BMC was required to issue a notice to illegal structures under sections 351 and 354 (a) of MMC Act before it could go ahead with demolitions.

Kunte said the civic body would now be able to act against multi-storey buildings. "We are also appointing a private agency to help with demolitions," he said.

The agency would have the right machinery and safety measures in place to undertake large demolitions, including of buildings with reinforced cement concrete (RCC). The amendment, which does not apply to illegal structures in slums, however, will not stop the affected parties from seeking stays from Bombay High Court.

But Kunte believes getting a stay from HC would not be easy. "Here, the proof of legality of a structure needs to be attached with a writ, which is not generally available as most of these cases have severe illegalities," he said.

Following the Mumbra building collapse that claimed 74 lives, BMC has set stringent guidelines for action against unauthorised, and dilapidated and dangerous buildings. The civic body has demolished 18,309 residential and 11,227 commercial structures in the past three years and removed 30,272 slumdwellers.
