Petitioner wants Delhi not to go ahead with plan to regularise 917 colonies

The Delhi High Court on Wednesday sought replies from the Union Government, the Delhi Government and the Delhi Development Authority on an application seeking a direction to the city government not to go ahead with the reported plan to regularise as many as 917 unauthorised colonies in the Capital.

Issuing the notices, a Division Bench of the Court comprising Justice A. K. Sikri and Justice Rajiv Sahai Endlaw asked the respondents to file replies to the petition by September 6, the next date of hearing.

Submitting that the Delhi Government could not regularise these colonies as the petitions challenging their regularisation were still pending before the Court, the applicant stated that the Delhi Government was acting mala fide and pursuing electoral agenda to appease the public in abject disobedience and disregard of the Constitutional provisions cited by the petitioners and prima facie view taken on this by the Court.

In case the Government succeeded in its plan to illegally regularise these colonies, not only would this perpetuate illegality but would also render the petitions largely futile and infructuous and frustrate the endeavour of the public spirited petitioners, the application said.

The applicant urged the Court to restrain the respondents from making any declaration and pass any order to give any direction regarding regularisation of these unauthorised colonies in any manner and by any means during the pendency of the petitions.
