Punjab HC quashes town planners’ notices to residents of Gurgaon

The Punjab and Haryana High Court has quashed the Directorate of Town and Country Planning’s (DTCP) notices to people for misuse of property, saying the department has no jurisdiction over areas within municipal corporations.

Dealing with a bunch of over 80 petitions, wherein residents of Gurgaon had challenged the DTCP’s notices, a division bench of Justice Hemant Gupta and Justice R N Raina has said the department cannot issue such notices.

The court said only the municipal commissioner would be the competent authority to issue such notices and take appropriate action. The judgment was significant because all DTCP notices issued since 2008, when the Municipal Corporation of Gurgaon was formed, would, henceforth, be redundant and scrapped.

The court said action on any violation of property rules could be initiated only by the municipal commissioner.

The court also dismissed Haryana Advocate General Hawa Singh Hooda’s argument that the Municipal Act was enacted to prevent haphazard and sub-standard development in a “controlled area”.

In its judgment, the High Court said different authorities have been empowered to act in their areas of jurisdiction such as the municipal commissioner within the civic agency’s limits and the DTCP in “controlled area and scheduled roads” outside the municipal limits. This was done to avoid overlapping of jurisdiction.

Civic amenities for unauthorised structures

PUNE: The Pimpri Chinchwad Municipal Corporation (PCMC) has officially moved a proposal not to give civic amenities to unauthorized constructions. The move is to prevent more unauthorized constructions coming up.

Shrikar Pardeshi, municipal commissioner, said, "The high court has directed the civic body to take action against unauthorized constructions in the city. The state government has also directed the civic body to implement the court directive. The civic administration has started a drive to remove unauthorized constructions in various parts of the city. It has also been decided that the civic body will not give basic amenities to any new unauthorized construction coming up in the city."

Pardeshi said a proposal has been tabled before the law committee. The PCMC will also tell the Maharashtra State Electricity Distribution Company Limited to check the documents before giving electricity connections to ensure that only authorized constructions get the connections, he said.

"If the unauthorized constructions do not get water supply, drainage, approach roads, street lights, then no one will buy those property in buildings constructed without permission. This will reduce the rampant growth of unauthorized constructions in the city. After the law committee approves the proposal, it will be sent to ;The proposal will be sent to

the civic general body for approval. We will start implementing the proposal after the GB approves it," Pardeshi said. The proposal will come up for discussion before the law committee on September 7. Of the nearly 3 lakh properties in the city, 1.1 lakh are unauthorized constructions.

In an apparent dig at the recent CAG reports, Urban Development minister Kamal Nath today said that the government's decision to regularise the unauthorised colonies in Delhi was based on ground realities but "somebody" could allege that this constituted a presumptive loss to the exchequer.

"The question today is what is desirable and, on the other hand, what is feasible. I spoke about colonies, nearly 1,640 of them which are on government land. I spoke about it, tomorrow someone will say that so much land has been given, there is going to be presumptive loss," he said.

The minister was speaking after delivering a speech at the office of CAG where he had come to participate in a seminar on Performance Reporting for Urban Local Bodies."It can be a presumptuous loss but someone tells what is the way out," Nath said, adding that he was not talking about any theory but about ground realities.

"This was a seminar on urban local bodies, municipalities, nagar palikas, nagar panchayats. I did say we have to practice the art of the feasible and not the art of the desirable... There was no question of praising or criticising. This was a focussed seminar, so I spoke on the subject and did bring in concerns which are there in implementation. Concerns in Urban local bodies in implementation, etc," he said.

"There is no question of criticising or praising. I did say that the CAG has an important role in the country. That is the institution of the CAG and that is what is envisaged in our constitution," the Urban Development minister said.

Nath also said there should be a continuous dialogue between the audited body and the auditor. "Between the audited entity and the CAG, there must be continuous dialogue so that they are on the same page," he said.

When asked to comment on the CAG report on coal block allocations, Nath said, "The CAG reports to the Parliament. It will be highly improper for me to comment on what the Parliament is looking at. At the moment it is the Public Accounts Committee which will comment on the contents of the report."'Goldman Sachs' torched at Burning Man Festival.
