‘Civic body can’t renew licences as none meets new norms’

The civic administration, indicating that all hoardings in the city are illegal, on Wednesday said that their licences cannot be renewed as they do not meet the norms prescribed under the new policy.

“The Pune Municipal Corporation’s hoarding policy is pending with the state government for final approval. We cannot give permission for hoardings as per the previous norms when the new policy is all set to come into effect,” said Municipal Commissioner Mahesh Pathak. The issue was raised by corporators in the civic general body meeting.

When corporators raised the issue of losses incurred due to non-renewal of licences, Pathak said, “There are at least 16 norms for hoardings. None of the hoardings fulfil the criteria, and can’t be issued licences.”

The civic chief said there has been a constant demand for renewal of licences for hoardings. “The PMC found that under the new policy, the revenue was six times higher. In this situation, allowing hoardings as per old policy will result in a huge loss to the PMC,” he added. The civic administration has also initiated action against illegal hoardings, but some have managed to obtain a stay, he said.

Corporators led by Congress leader Avinash Bagawe said the PMC should also make the civic staff responsible for the losses due to failure to take action.

The civic administration also informed the general body that the number of illegal hawkers in the city was almost the same as licensed ones. “The total number of hawkers in the city is 14,000, of which 7,224 are authorised,” said Ramesh Shelar, in charge of anti-encroachment department of PMC.

Corporators condemned the civic administration for failing to keep a check on the illegal hawkers and highlighted the issue of increasing crime rate due to illegal hawkers in Tulshibaug area.

Shelar said Tulshibaug area has 289 authorised hawkers operating every day but the number of illegal hawkers is barely 10.

“The civic administration plans to rehabilitate the authorised hawkers. Space for rehabilitation is available in the merged villages,” he said.

Proposal to get Gandhi, Phule titles registered

CITING lack of official records, the general body of the PMC on Wednesday approved a proposal for registration of titles ‘Rashtrapita’ for Mahatma Gandhi and ‘Mahatma’ for social reformer Jyotiba Phule. The resolution will now be forwarded to the state governemnt . It was tabled by NCP leader Ravindra Malvadkar, BJP corporator Dhananjay Jadhav and NCP leader Anil Tingre.

Delhi high court seeks govt's stand on plan to regularize colonies

NEW DELHI: The Delhi high court on Wednesday sought the city government's stand on its proposed move to regularize unauthorized colonies.

A division bench comprising acting Chief Justice A K Sikri and Justice Rajiv Sahai Endlaw asked the government to respond to a plea seeking to stop the government from taking any decision for regularization of unauthorized colonies. Issuing notice also to the Centre and the DDA, HC gave them time till September 6 to file their reply.

Urging HC to bar the government from taking any decision on the contentious issue, the petitioner's counsel, Anil Aggarwal, argued "this court is yet to decide a plea, filed by an architect and town planner, questioning the Centre, the city government and DDA's power to regularize the unauthorized colonies."

"Restrain all the respondents from making any declaration or pass any order or give any direction regarding regularization of unauthorized colonies in the NCT of Delhi in any manner and by any means whatsoever during pendency of the petition," the plea filed by H R Suri ex-president of the Institute of Town Planner (India).

Citing a TOI report in which the chief minister promised to declare 917 unauthorized colonies as regularized soon, the petition asked HC to intervene. "In case, the respondents succeed in their plans and designs to illegally regularize the colonies, not only would this perpetuate illegality but will also render the petition largely futile," says the application.

Petitioner wants Delhi not to go ahead with plan to regularise 917 colonies

The Delhi High Court on Wednesday sought replies from the Union Government, the Delhi Government and the Delhi Development Authority on an application seeking a direction to the city government not to go ahead with the reported plan to regularise as many as 917 unauthorised colonies in the Capital.

Issuing the notices, a Division Bench of the Court comprising Justice A. K. Sikri and Justice Rajiv Sahai Endlaw asked the respondents to file replies to the petition by September 6, the next date of hearing.

Submitting that the Delhi Government could not regularise these colonies as the petitions challenging their regularisation were still pending before the Court, the applicant stated that the Delhi Government was acting mala fide and pursuing electoral agenda to appease the public in abject disobedience and disregard of the Constitutional provisions cited by the petitioners and prima facie view taken on this by the Court.

In case the Government succeeded in its plan to illegally regularise these colonies, not only would this perpetuate illegality but would also render the petitions largely futile and infructuous and frustrate the endeavour of the public spirited petitioners, the application said.

The applicant urged the Court to restrain the respondents from making any declaration and pass any order to give any direction regarding regularisation of these unauthorised colonies in any manner and by any means during the pendency of the petitions.
