Court orders govt action against illegal buildings

In the wake of the building collapse incident in Lalita Park in which 70 people were killed, a Delhi court has asked the government and the MCD to take precautionary measures against illegal constructions and rickety buildings. The court's order came on the complaint by a city resident Rajender Chabra, who had entered into an agreement in 2005 with a real estate company, M/s Showman Construction and Impex Private Ltd, and its three directors to construct a house on his plot at Greater Kailash in South Delhi.

"The building is situated in a thickly populated urban colony, posing danger to human habitation in the neighbourhood... The state is directed to do the needful in such matters," additional chief metropolitan magistrate Rakesh Pandit said.

The Economic Offence Wing of the Delhi police, in its status report, had endorsed the allegations of the complainant, saying "the material used in constructing the house were of very poor quality and the building was prone to get damaged during earthquakes."

It was also opined in the report that the building should be immediately "dismantled".

The court, which had earlier ordered registration of an FIR against the company and its directors, asked the government, the Municipal Corporation of Delhi (MCD) and the police to take necessary steps.

Earlier, the court had ordered registration of an FIR against the real estate company, and its four officials - Avdhesh Mittal, Sunil Goyal, Ashok Gupta and Bharti Dogra - under various provisions of the IPC, pertaining to cheating, restraining a person and criminal conspiracy.

Pune:  Pushing ahead its reforms to ensure speedy services further, the Pune Municipal Corporation is set to undertake an initiative to clear building permission proposals within a day.

The decision has been welcomed by those in the real estate industry, who believe the benefits of the move would be transmitted to the consumers as it would aviod cost escalation owing to delay in projects.

The civic body also aims at keeping no proposal pending by mid-December. As per norms, the PMC is supposed to clear the proposals in two months from the date of application. “The civic body clears the proposals in the stipulated time but a few proposals remain pending, due to technical flaws or lack of certain documents. The civic chief has set a target for the department to achieve no pendency by December 15,” said Vivek Kharwadkar, additional city engineer.

He said the department is working on making the process speedier by setting up a schedule for the steps involved in clearing the proposals. “There should be either clearance or rejection of proposals within the stipulated time,” Kharwadkar added.

The ongoing move to accelerate the process of clearing building construction proposals, has yielded the PMC around Rs 100 crore in a month’s time, collected as development charges for approved proposals. A senior civic official said, “The administration would soon initiate the process of sitting across the table with architects to resolve the issues because of which several proposals are pending for long. A meeting with the Pune chapter of the Confederation of Real Estate Developers Association Of India ( CREDAI) was held to discuss the matter.” 

“The PMC recently held a discussion with us to bringing in reforms to speed up building permission process,” said Satish Magar, president of CREDAI, Pune. “The administration had been taking too much of time on proposals. This led to increase in the project cost and the heat was faced by the customers,” he said. he however praised the recent steps, taken by the PMC in one month has eased the situation and proposals are getting cleared fast. “The revenue of PMC from development charges in a month reflects the positive impact of the reforms. It was in the interest of PMC, developers and customers,” Magar added.

Kharwadkar said that the reforms were being made reposing trust in developers and the real estate industry has to ensure that no one takes unneccessary advantage of the reforms. “If the developers fail on the trust shown, then the entire industry will suffer due to it. We do not want honest developers suffer due to few miscreants,” he added.

AHMEDABAD: The Gujarat high court on Tuesday pulled up the Ahmedabad Municipal Corporation (AMC) for being "very slow" in its sealing drive. It also gave shopkeepers on CG Road one month to find a plot for proper parking. The court directed the AMC to take action against all building owners who do not follow by-laws.

The shop-owners' association on CG Road told the court that they had identified four plots where temporary parking facility could be created. A free taxi service would ferry customers from the parking lot to different places. However, the division bench, headed by the Chief Justice asked the association to locate the plot within 500 metres of the road.

The court told the association that the new parking space should be as large as 30 per cent of the FSI of all buildings on the stretch. The Chief Justice also asked the traders not to include the margin space in front of the buildings while measuring the FSI. "If proper space for parking is not created, I will get extra construction pulled down till my retirement," the CJ warned.

The high court gave shopkeepers of CG Road and Gopal Tower in Maninagar one month to set things right and obtain due clearances from the authorities. When the court asked AMC whether the situation was the same as CG Road in the in rest of the city, the civic body's counsel said yes. The judges instructed AMC officials to increase the pace of their sealing drive. "You people are very slow in sealing property and this can be seen from the fact that very few people have approached this court," the chief justice commented.

This proceeding has been going on for last two years on various applications filed by advocate Amit Panchal. He has demanded that earlier orders issued by the high court for implementation of building laws and traffic rules be followed in the right manner.
