Government to submit report on lake development

BANGALORE: The High Court on Thursday directed the state government to submit an action taken report on the development of lakes in the city.

The court was hearing a public interest litigation filed by the Environment Support Group (ESG) challenging the state government's decision to lease out lakes.

The division bench, comprising Chief Justice J S Khehar and Justice A S Bopanna, asked the advocate general to submit an action taken report within two weeks.

The petitioner has submitted that the lakes have been given on lease to private parties violating a previous court order.

The petitioner's advocate submitted that fish have died in Avalahalli lake because of some road work undertaken near it.

Advocate General Ashok Harnahalli submitted that on September 17, 2009, the court directed all lakes in the city to be maintained in their original position and not alienate the nature of the lakes and also directed to submit an action taken report.

The BDA and Lake Development Authority has to submit compliance and action taken report to the High Court. The court adjourned adjourning the hearing to November 26, the court directed to file an ATR to the court.

BDA to follow law on unauthorised layout

The Bangalore Development Authority (BDA) has submitted in the High Court that it will take action against the unauthorised layout of Housing Minister Katta Subramanya Naidu in accordance with law.

Hearing the petition filed by the minister, his wife K Sowbhagya, former MLA of Turuvekere MD Lakshminarayana and brother of Lakshminaraya MD Murthy, Justice Rammohan Reddy asked them to submit a list of sale holders of the sites in Byatarayanapura.

Earlier, the petitioner had given an undertaking that they will maintain status quo on the property in question at Byatarayanapura on Mysore Road, which has been declared unauthorised by the BDA.

The court adjourned the hearing to November 2 to enable the petitioner's counsel to submit the list of sale holders of the site.

The BDA had directed the petitioner to remove the unauthorised constructions on plots, survey number 7/2 and 7/3, of Byatarayanapura.

Katta and his family members had purchased the property from M/S Mysore Machine Manufacturer Ltd in 2005 and Khata was made in favour of the petitioners by the BBMP.

The BDA issued show cause notice to the petitioners on May 2, 2009, asking why action should not be taken under section 17 (4) of the Karnataka Town and Country Planning (KTCP) Act, 1961, and also discontinue the development works undertaken in the property.

In January 29, 2010, the BDA issued demolition order of the unauthorised layout because the petitioner did not take permission under the KTCP Act.

The petitioners challenged the demolition notice issued by the Commissioner of BDA.

They submitted that the BDA commissioner was not the planning authority and that the government has decided to regularise the layout under Akrama Sakrama scheme and when the regularisation was pending consideration, no demolition can be carried out.

BMC halts crackdown on illegal mobile towers

The drive against illegal mobile towers in the State capital has succumbed soon after it was launched. Bhopal Municipal Corporation (BMC) the civic agency responsible for removing the illegal mobile towers in all 70 wards of the city has halted it without any substantial reasons.

Ironically, BMC officials confirm that instead of removing the illegal mobile towers, efforts have now been initiated to legalise the towers, which were earlier notified as illegal by the civic body.

Irrespective of the location of the towers — in residential areas or on high-rise buildings, the Corporation is willing to come out with an alternate solution for the problem, they added.

The BMC has already invited telecom companies, operating their services through these towers, to join the negotiations for regularising these ‘illegal’ towers.

It may be mentioned that, nearly 320 mobile towers in Bhopal belong to various companies including Airtel, Idea, Reliance and other companies

In a survey carried out by the BMC few months ago, 158 of the total towers were described as illegal. After a report carried by The Pioneer in its issue dated July 27, the Corporation initiated a full-fledged drive to remove illegal mobile towers.

However, the drive was suspended after removing barely 40 such illegal mobile towers. Meanwhile, the BMC has uncapped plans to come up with an agreeable solution to legalise the remaining 118 towers, at the place where they stand.

Sources said that around 50 of the total 158 mobile towers have already been granted a stay by the court and the BMC move was aimed at stopping others from seeking respite from the judiciary.

The BMC now proposes to overlook the norms flouted in setting up of these towers and legalise them, provided the telecom operators are ready to complete the remaining formalities.

As per the rules, mobile towers can only be installed at premises after their strength and load-bearing capacity has been certified. The Civil Engineering Department of MANIT has been linked for the purpose.

Further, No Objection Certificate (NOC) from the zonal committee and other legal documents are also required before the permission is issued by the BMC.

Close on the heels of the BDA land denotification scam, another land scam involving several crores of rupees has been unearthed.

Head of the erstwhile Legislature Committee on encroachment of government land in Bangalore A T Ramaswamy on Wednesday said the State government has given away valuable land to a private builder in exchange of a plot of a lesser value by flouting all the rules.

A City-based builder Yousuff Shariff had in November 2008 successfully bid for 12.24 acre land in Kothaganoor village of Bangalore east taluk at Rs 4.94 crore (Rs 40 lakh per acre) after participating in an auction conducted by the Revenue department.

“He took possession of only 5.37 acre. He informed the department that he had not been able to take possession of the remaining 6.27 acre because of opposition from the local people. The department, through its order dated April 1, 2010, handed over the same extent of land at Doddajala of Bangalore north (additional) taluk (close to Bengaluru international airport) at Rs 60 lakh per acre. Yousuff had petitioned to the Revenue Minister Karunakara Reddy to hand over the land. The market value of the land in Doddajala is Rs one crore to three crore per acre,” Ramaswamy alleged at a press conference.

Auction cancelled

The Revenue department, he charged, had cancelled the auction of the land in Doddajala twice citing under-bid value as the reason. When the department tried to auction the land in October 2007, the highest bid per acre was Rs 77 lakh. Yousuff himself was a bidder at Rs 76 lakh for this land. But the department cancelled the auction stating that the market value was much higher. Later in September 2009 re-auction was conducted, but that too was cancelled without citing any reason.

The Revenue department subsequently gave away the land in Doddajala to Yousuff despite the Karnataka Public Lands Corporation advising against it.

Huge loss

“The Corporation had told the department that there was no provision for exchange of land in favour of a bidder in the rule book and the government is going to incur huge loss. Moreover, there was no obligation on part of the government towards the bidders as far as auction was concerned. Still the land was given in exchange. This is an act of impropriety apart from being illegal,” Ramaswamy, who is a JD(S) leader, said.

He further alleged that out of 643 acre land auctioned by the department so far at Rs 540 crore between 2005 and 2009, Yousuff has bought 283 acre for Rs 280 crore on behalf of five companies as a GPA holder. “He is the single biggest beneficiary of the land auction. Most of the auctions appear to be rigged,” he alleged.

This apart, the department has gone out of the way to help the builder. It had approached the BDA to change the land use for some portion of auctioned plots that were falling in the green belt, he alleged.

Ramaswamy urged the government to order Lokayukta probe into the scam, besides cancelling its order to exchange the land.
