Clean up vacant plots or else, BBMP tells property owners

HAZARD TO ALL:Negligent property owners will have to cough up fines three times the cost the civic body incurs for the clean up.

BANGALORE: The Bruhat Bangalore Mahanagara Palike (BBMP) has directed owners of vacant sites in Yelahanka coming under its jurisdiction to clean up their plots within a fortnight's time or face action.

The warning comes in the wake of an inspection carried out by BBMP health officials in areas around Yelahanka here on Tuesday where the officials noticed that vacant plots were ill-maintained.

In a release, the BBMP said that on failing to meet the deadline, owners of sites which are not cleared will have to cough up as fine thrice the amount of maintenance costs that the palike incurs after its workers carry out the work.

“Ill-maintained vacant sites are breeding grounds for mosquitoes, snakes and weeds such as parthenium. They also become dumping grounds for garbage,” said a BBMP health official.

Meanwhile, a cleaning drive was undertaken by palike workers on Monday in areas around HAL Airport, A. Narayanapura, K.R. Puram and Mahadevpura.

BBMP Commissioner Siddaiah will carry out informed inspections every Friday covering two or three roads to interact with residents and know their problems. .

Mayor S.K. Nataraj and Commissioner Siddaiah visited K.R. Market on Tuesday to explore the possibility of setting up a wet waste segregation and processing unit on the premises.

BBMP warns penalty on filthy vacant sites

Bangalore, Oct 5, DHNS:

The Bruhat Bangalore Mahanagara Palike has warned of imposing penalty on the owners of filthy vacant sites.

The Palike will ask the property owners to clean their sites within fifteen days failing which it would clean the site and impose penalty to the tune of three times the labour charges. The Palike Commissioner has directed all the zonal chiefs to take up the task. Yelahanka Zonal Additional Commissioner Ravindra has issued a circular to residents of his zone to clean the vacant sites within fifteen days.

“We have instructions to collect penalty as ‘arrears of revenue’ if we are forced to clean the vacant sites,” said Ravindra.

Earlier to BBMP elections, the Residents’ Welfare Associations had complained on filthy vacant sites and now the corporators have been raking up the issue at the Council meetings.

Some corporators whose houses are located next to vacant sites are learnt to have made a representation to Mayor S K Nataraj and Commissioner Siddaiah to consider the matter seriously.

‘Legal hurdle’ to check violation of building plans

Lack of statutory authority to initiate action against officers erring in sanctioning plans seems to be one of the detriments in checking building bye-law violations.

There is no specific law to prosecute plan sanction authorities for their omissions.

According to officials in the Palike, the blame for violation cannot be put on a single person. The State Government recently amended Section 76F of the Karnataka Town and Country Planning (KTCP) Act to hold the officials who sanctioned building plans responsible for violations.

No provision for action

“However, there is no specific provision to initiate action against such officers,” the source pointed out.

Section 76F states: “The State Government or the Planning Authority concerned or any person authorised by the State Government or the Planning Authority in this behalf by general or special order may either before or after the institution of the proceedings compound any offense made punishable by or under this Act.” According to sources, the ‘anomaly’ in the Act has become a safe shelter for erring BBMP officials.

It is estimated that nearly eight lakh properties have violated building bye-laws in the City. The violation is fifty per cent in half of such properties. With Akrama-Sakrama scheme yet to secure Governor’s nod, officials need to be provided with a ‘lawful teeth’ to tame building bye-law violations.
