Cabinet to decide on RWH deadline

A final decision on extending the deadline for installation of rainwater harvesting structures in the City buildings is expected in the Cabinet meeting scheduled for Tuesday.

The amendment to Section 72A of the BWSSB Act in August 2009 mandates installation of RWH structures in all new buildings with a sital area of 1,200 sq ft (30X40 ft) and existing buildings of 2,400 sq ft (40X60 by May 27, 2010.

While the structures have been installed in about 15,000 buildings, the owners of the rest have sought more time to comply. A RWH structure costs anywhere between Rs 15,000 and Rs 20,000.

The Board had submitted a proposal to the government to extend the deadline in view of the plea from the public.  Tuesday’s Cabinet meeting would decide on the additional time to be granted following which the legislation will have to be amended once again.

Waste water treatment

The Cabinet is expected to give administrative approval for sanction of funds to install waste water treatment plants at Bangalore Medical College and Research Institute Hospital, Victoria Hospital and Bowring and Lady Curzon hospitals.

The Karnataka State Pollution Control Board had issued notices to these hospitals for not installing the plants. The government is expected to grant approval for release of Rs 8.39 crore to install the plants and another Rs 3.39 crore for clearing BWSSB dues.

Other issues that are likely to come up before the Cabinet are withdrawal of police cases registered in connection with riots and protests at different places, UGC pay scale for staff of BEd Colleges, increase in quantum of compensation to those who part with their land for KIADB and extension of Vajapayee Arogya Sree scheme to districts in Belgaum division.

BANGALORE: In an exceptional case, the Karnataka High Court has directed the Bangalore Development Authority (BDA) to refund Rs 20,73,914 to one Shetal Udayakumar, out of the Rs 63,41,200 deposited by her late husband in 2007 for two corner sites in HRBR Layout II Stage.

Justice Rammohan Reddy gave this direction, asking the BDA to refund the amount within eight weeks, while disposing of a petition filed by the Banaswadi resident, seeking refund of the amount deposited by her husband at the time of auction.

"Though the statutory rules permit the BDA to forfeit the amount for non-payment of the balance sale consideration, in the circumstances of the present case, the BDA should refund Rs 20.73 lakh, after forfeiting Rs 42,67,686 as shortfall amount upon the re-auctioning of the two sites," the judge observed in his verdict.

As per Section 6(3) of BDA (Disposal of corner sites and commercial sites) Rules, 1984, if a successful bidder doesn't deposit the entire amount within 45 days after the sale confirmation, the initial amount, which is 25% of sale consideration amount, is liable to be forfeited. Under 6(4), the BDA can extend the period by 90 days for paying the balance amount, subject to payment of interest at the rate of 18%.

The petitioner has claimed that her late husband had left huge debts and representatives of banks and financial institutions are hounding her to recover those loans. She challenged the endorsement issued by the BDA, forfeiting the 25% bid amount deposited by her husband.

The BDA, by its July 5, 2008 communication, cancelled the auction bid and also forfeited the amount paid by the petitioner's husband. Later, the BDA put up the two sites for re-auction on August 19, 2009, and the bid amount was Rs 2.10 crore. The BDA claimed it had to incur a loss of Rs 42.67 lakh on account of cancellation of the auction where the petitioner's husband was the successful bidder.

BACKGROUND

M Udayakumar, the petitioner's husband, had bid for two corner sites in HRBR Layout on October 30, 2007. The bid amount was Rs 90,85,676 and Rs 1,62,78,582 respectively. Accordingly, he deposited Rs 63,41,200 as 25% of the bid amount in terms of the auction rules. But on November 9, 2007, he fell ill and was admitted to St John's Hospital.

He was diagnosed with Non-Hodgkins Lymphoma and post chemotherapy, died on January 26, 2008, on account of multiple organ failure.

GHMC to ‘fast track’ building permits

HYDERABAD: The Greater Hyderabad Municipal Corporation (GHMC) is going fast track by giving building permissions in four days, with the launch of a novel concept called Green Channel.

Green Channel is an initiative to remove bottlenecks and facilitate construction work in the GHMC area. Under this facility, owners or builders will have the option to obtain expeditious approval of building permissions. GHMC officials said the new initiative will enable applicants to obtain building permissions from zonal and circle offices in four clear working days for plots up to 1,000 sq m and buildings with ground plus 3 floors. The new facility would be purely optional and not mandatory.

Applications for the new system will be received at the special Green Channel counter in the citizen service centres of all circle offices. Applicants would not be charged additional fees and charges for obtaining these permissions.

GHMC officials said the applicants who want to use the facility must approach architects registered with the GHMC for required scrutiny of their plans, to ensure conformity to the Master Plan, zoning regulations, building rules and regulations and orders issued by the government from time to time. Along with the building application, the registered architect should submit a certificate saying that all the rules and regulations have been adhered to and he is personally held responsible for any lapses in this matter.

On completion of the necessary scrutiny and certification of building plans, the applicants should submit their plans at the Green Channel counter in full, duly enclosing all relevant documents with payment of the prescribed fee in the form of a DD or pay order in favour of the commissioner, GHMC. The submitted plans will be scrutinised by the concerned town planning officials and permissions will be given within four clear working days without any site inspection. In case the staff fail to process the application within the stipulated time period, a penalty of Rs 50 per day will be levied on the concerned staff as per the Citizen Charter.
