Isha Foundation Constructed 62 Illegal Buildings in Kovai, Says Govt

The Isha Foundation, founded by Sadhguru Jaggi Vasudev aka Jagadeesan, has already constructed 62 buildings and been putting up another 15 buildings without approval from government authorities on the foothills of Velliangiri near Coimbatore, the Deputy Director of Town and Country Planning, Coimbatore region, submitted in counter affidavit filed in the Madras High Court on Tuesday.

The counter was filed in response to a PIL from advocate M Vetriselvan, praying for a direction to the authorities concerned to demolish the unauthorised constructions. The counter said that the Foundation commenced the construction in 1994. But it had not obtained the clearance from the Hill Area Conservation Authority, which came into existence in 1990. Prior approval from the Coimbatore Collector was necessary as per the provisions of Town and Country Planning Act and TN Panchayat Buildings Rules. But the Foundation has not obtained the clearance from the Collector and the Deputy Director of Town and Country Planing. Hence, ‘lock and seal and demolition’ notice was issued to the Foundation in December, 2012.

In July, 2011, it had submitted proposals for construction of 12 buildings, but it was returned with a direction to resubmit in full shape in February 2012. In September same year, the Foundation resubmitted the proposal and during inspection by the officials in October, it was found that the construction has already begun and the building plan was not tallying with the actual.

The Foundation was directed to resubmit the plan as per the construction made at the site along with NOCs from the Forest, PWD, Collector and others. As the construction was not stopped, ‘stop work’ notice was issued on November 5, 2011. Subsequently, sealing notice was issued on December 24, 2012, the counter said and the proposals were returned as they were not in full shape in January this year.

Official makes submission before First Bench

The Deputy Director of Town and Country Planning, Coimbatore region, has submitted before the Madras High Court that Isha Foundation constructed buildings at Ikkaraibolluvappatty village, without any valid approval from competent authority.

The official made this submission before the First Bench headed by Chief Justice R.K. Agrawal, who was hearing on a public interest litigation filed by M. Vetri Selvan, an advocate who had sought a court order for demolishing all the “unauthorised buildings” constructed by the foundation in the village in Coimbatore district.

In his counter, K. Sabapathy, Deputy Director of Town and Country Planning said, “The Isha Foundation has neither obtained approvals from the District Collector, nor obtained the concurrence of the Deputy Director of Town and Country Planning as required provisions of the Tamil Nadu Panchayats Building Rules 1997. It has not obtained clearance from Hill Area Conservation Authority, the foundation constructed 62 building blocks which are in use and 15 building blocks are being constructed without any valid approval from the competent authority. The school in question is being run in one of the constructed building. Hence, lock and seal demolition notice was issued last December.”

The official added that a proposal of foundation for approvals for the construction of buildings was returned in last January.

Mayor seeks funds from Finance Commission

Mayor V.V. Rajan Chellappa sought financial support for operation and maintenance of underground sewerage and solid waste management systems in the city at the 14{+t}{+h}Finance Commission meeting held in Chennai on Monday. According to a release issued here, the Mayor had sought funds to dispose of waste scientifically and according to the Pollution Control Board norms.

He asked the Commission to reduce the financial sharing of the project by the urban local body to 10 per cent as the project cost was more than its financial capacity.

Observing that the implementation of most of the projects got delayed as the local bodies were required to get clearance from several public sector departments such as the railways, National Highways Authority of India and Airport Authority of India, the Mayor urged the Centre to set up a single window clearance system for all projects being executed with the financial assistance of the government for their timely completion.
