Corporation seals buildings within gated community

COIMBATORE: The Local Planning Authority (LPA) and Coimbatore Corporation on Tuesday sealed the club house and shops at a gated community, east of Nanjundapuram Road.

According to an LPA official, the project was accorded approval in 2003 for 160 residential dwellings, a club house and commercial complex.

Deviations

The construction, however, was not as per the approved plan. The source said there were deviations as the club house was constructed on a canal.

The commercial complex was constructed encroaching upon the parking space. It also exceeded the approved area.

Notice served

The LPA served show-cause notice in 2009 and an appeal by the project promoter was rejected by the Directorate of Town and Country Planning.

Following the rejection, the LPA and the Corporation sealed the club and the commercial complex, curtailing the use of the two buildings.

Corporation Commissioner Anshul Mishra said a bank that had rented a portion of the unauthorised structures was given time to move out.

For practical reasons the bank's branch would function there for a month or so and then move out.

Time given

The civic body had also given time to a finance company there to shift its office following a representation from the latter's representatives.

Mr. Mishra said that the civic body would issue a notice to the property promoter to take possession of a road that was supposed to have been handed over to the local body, as marked in the layout. This was a violation of law and the civic body would ensure that the road was also taken over.

The move would serve as a warning to violators and send a strong message that the Corporation would not hesitate to take action against offenders.

The building on Yadaval Street, Padi, which was sealed on Monday by Ambattur Municipality.

CHENNAI: Two buildings in the city and a suburban area were sealed on Monday for violations.

A release from the Chennai Metropolitan Development Authority (CMDA) said the owner of a building bearing new door No.10, old door No.5, Dr. Rathinasabapathy Street, Tondiarpet, obtained planning permission on March 31, 2009 from the Chennai Corporation for construction of a stilt floor plus two floors residential building.

But, the building, under construction now, has stilt floor (part), ground floor (part) plus three floors and fourth floor built in part. This is in deviation to the approved plan and has violations pertaining to additional floors, road width, parking and floor space index.

It was locked and sealed according to the provisions of Sections 56 and 57 of the Town and Country Planning Act, 1971, the release said.

Another building on Yadaval Street in Padi, coming under the jurisdiction of Ambattur Municipality, was also locked and sealed by the officials of the Town Planning Department of the local body.

An official said the owner of the building had obtained approval in 2008 to construct a residential building with ground floor plus first floor. However, the building has an additional floor and it had been converted into a commercial one.

The local body had served a notice a month ago about the deviations and asked the owner to demolish the additional floor. As there was no response, the building was sealed.

CHENNAI: The High Court on Thursday ordered notice on a PIL petition seeking to quash the CMDA order of July last year providing for reservation of 15 per cent plots/houses/flats/shops etc. for allotment under the Chairman's discretionary quota.

Parithi Ellamvazhuthi, Information Minister, CMDA Chairman, has been cited as one of the respondents.

The petitioner, K. Karthikeyan of Annanagar West, an advocate, said that on January 4, 2009, the CMDA had notified a draw of lots for the sale of 200 shops in Koyambedu Wholesale Market Complex. Due to the creation of discretionary quota for the CMDA Chairman, the twice notified auction was postponed and subsequently cancelled for administrative reasons. The Tamil Nadu Town and Country Planning Act under which the CMDA was created, did not provide any power to the Authority to create discretionary quota for its Chairman. When the discretionary quota was created, no guidelines had been framed.

The petitioner alleged that 26 shops had been sanctioned under the discretionary quota. This act was arbitrary and illegal, he said.
