Plea against shop over wrong use of residential plot

CHENNAI: With violation of building rules continuing unabated in the city despite the high court striking down the state government's three earlier regularisation schemes aimed at condoning such violations, residents are increasingly approaching courts to prevent such illegalities and secure their right to quality life.
Acting on a petition filed by the residents' welfare association of Mangesh Street off North Usman Road, seeking to restrain Saravana Stores Thanga Maligai from constructing an allegedly illegal building adjacent to its present jewellery showroom in the heart of T Nagar, the Madras high court has sent notices to the promoters, municipal administration secretary, Chennai Metropolitan Development Authority (CMDA), Chennai Corporation and additional commissioner, Chennai traffic police.

The petitioner, R Ramani, president of the association, alleged that the retail giant purchased two residential plots on Mangesh Street and put them into commercial use by clubbing them with an adjacent commercial plot, which abuts the Doraisamy Road. The promoter has got planning permission from the CMDA to construct an office building on the premises and Chennai Corporation has issued building permit also. Both the agencies apparently overlooked misuse of residential land.

As per rules, no commercial activity can be carried out on a residential plot. To circumvent this rule, the promoter showed the residential plot as car park area for the proposed office building, which is under construction. Ramani further charged that the actual intention of the promoter is to convert the new building also into a jewellery shop. Such activities would put undue strain on Mangesh Street which has just six metre carriageway and hence it should be prevented, Ramani pleaded.

CMDA seals two buildings in Tambaram

CHENNAI: Continuing its crackdown against unauthorised buildings in the Chennai Metropolitan Area, the Chennai Metropolitan Development Authority (CMDA) along with Tambaram municipality officials on Tuesday locked and sealed two under-construction building on Mudichur Main Road in West Tambaram.

"Certain portions of these buildings were constructed violating the Town and Country Planning Act, 1971," Tambaram municipality commissioner N S Prema told The Times Of India.

According to officials, the owners of the buildings on Mudichur Main Road got permission in April 2009 for construction of stilt floor and three floors, including a ground floor, for commercial use. However, they began joining the portion meant for the stilt floor with the main building, violating the norms. This space is meant for parking and other purposes. They also began to deviate from the original plan submitted to the local body for approval. Despite being given ample time to correct themselves, the builders defied the rules. "Tuesday's exercise is a continous process in checking building violations. A few months ago, similar action was taken at Kapari on GST Road," said Tambaram municipality's town planning officer A Sethuraman.

Official sources said many builders get court orders suggesting their buildings are ordinary buildings (ground + three floors) as per government orders pertaining to Metrowater and Tamil Nadu Electricity Board and don't require CMDA completion certificates for service connections.

The CMDA's development control rules say any commercial building with more than ground plus two floors is a special building and requires a CMDA completion certificate.

The building on Mudichur Road, which was sealed on Tuesday for violations.

TAMBARAM: Officials of Tambaram Municipality on Tuesday sealed a multi-storeyed building under construction for allegedly violating plan permits.

Tambaram municipal officials said that the builder had sought permission for constructing a commercial complex on Mudichur Road in West Tambaram.

As per the plan, the ground floor was meant to be used as a parking lot.

Further, permission was only for constructing two floors above the ground floor.

However, the builder had built an additional floor above the second floor.

The ground floor, meant as a parking lot, was converted into commercial space with the construction of a few shops.

Though the building was yet to completed, officials said that they were acting as it had violated building norms.

When contacted, senior officials of Chennai Metropolitan Development Authority said they had not conducted the “raids and sealed the building” and that it was done by Tambaram Municipal officials under provisions of Delegation of Powers.

Officials of the Department of Municipal Administration and Water Supply said that a survey of buildings that were constructed in violation of building plan permits was currently being done and that notices were issued to the offenders.
