Plea to quash CMDA order

CHENNAI: The High Court on Thursday ordered notice on a PIL petition
seeking to quash the CMDA order of July last year providing for
reservation of 15 per cent plots/houses/flats/shops etc. for allotment
under the Chairman’s discretionary quota.
Parithi Ellamvazhuthi, Information Minister, CMDA Chairman, has been cited as one of the respondents.
The petitioner, K. Karthikeyan of Annanagar West, an advocate, said
that on January 4, 2009, the CMDA had notified a draw of lots for the
sale of 200 shops in Koyambedu Wholesale Market Complex. Due to the
creation of discretionary quota for the CMDA Chairman, the twice
notified auction was postponed and subsequently cancelled for
administrative reasons. The Tamil Nadu Town and Country Planning Act
under which the CMDA was created, did not provide any power to the
Authority to create discretionary quota for its Chairman. When the
discretionary quota was created, no guidelines had been framed.
The petitioner alleged that 26 shops had been sanctioned under the
discretionary quota. This act was arbitrary and illegal, he said.
